During the last five years how many times has the Local Government
Ombudsman (as a result of investigating a complaint against Mendip
District Council) brought to the attention of the council the fact
that a member of Mendip District Council staff had misled them,
lied to them or done anything else to hinder their investigation.
If they have what disciplinary action was taken against the
individual(s) concerned by the council.

Further to your recent Freedom of Information request which we received on
14 January 2009, please find below the information you require.

During the last five years how many times has the Local Government
Ombudsman (as a result of investigating a complaint against Shropshire
County Council) brought to the attention of the council the fact that a
member of Shropshire County Council staff had misled them, lied to them or
done anything else to hinder their investigation. If they have what
disciplinary action was taken against the individual(s) concerned by the
council.

In the last ten years we have had one case of maladministration formally
reported by the LGO. This case did not involve a member of Shropshire
County Council staff misleading, lying or otherwise hindering the
investigation.

Dear Mr Nunn

Further to your recent Freedom of Information request which we received on
12 October, we reply as follows.

You requested:

Over the last five years for yourselves and all the councils now
incorporated into Shropshire Council.

(1) How many Local Government Act Part III Section 32(3) notices has
each council served on a Local Government Ombudsman.

(3) How many times has the Ombudsman concerned found each council
guilty of maladministration for misusing a Section 32(3) notice.

Unfortunately, in this instance we are unable to process your request.
This is due to the cost of locating and retrieving the information, which
exceeds the appropriate cost limit of *450 set by law.

The Local Government Ombudsman's Office have confirmed that they deal with
your request. Please contact their Freedom of Information Officer at
[email address], telephone 020 7217 4734.

For information, the six Shropshire councils merged to make the unitary
Shropshire Council, were Shropshire County Council, Bridgnorth District
Council, Oswestry Borough Council, Shrewsbury & Atcham Borough Council,
North Shropshire District Council and South Shropshire District Council.

In accordance with the Freedom of Information Act 2000 this letter is a
refusal notice to your request. If you are not in agreement you are able
to make a complaint through the Shropshire Council complaints procedure,
details of which can be found on our website www.shropshire.gov.uk, or by
contacting me for a complaints leaflet. You are also able to ask the
Information Commissioner to intervene on your behalf on exhausting the
complaints process. If you wish to contact the Information Commissioner
you can find more details at www.ico.gov.uk or by telephone on 01625

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Shropshire Council's
handling of my FOI request 'LGO investigations.'.

Said notices are legal in nature and would have been served by your
legal team, therefore, there is no need to go to the trouble or
expense or searching all your complaint files just ask your legal
department how many notices they have served.

In addition, your monitoring officer, usually head of legal, is
statutorily and constitutionally obliged to bring all
maladministration to the attention of the council, therefore, they
will no the answer to the second part of my request without the
need to search all your complaint files.
