During the last five years how many times has the Local Government
Ombudsman (as a result of investigating a complaint against
Nottinghamshire County Council) brought to the attention of the
council the fact that a member of Nottinghamshire County Council
staff had misled them, lied to them or done anything else to hinder
their investigation. If they have what disciplinary action was
taken against the individual(s) concerned by the council.

Dear Sir/Madam

Thank you for your enquiry regarding the Equality Framework for Local
Government.

A copy of the Councils electronic response to the IDeAs draft EFLG is
enclosed. This was put together by corporate equality performance officers
following a series of workshops involving all equality lead officers in
departments and the Councils self managed workers groups ie Corporate
Lesbian, Gay and Bisexual Group, Corporate Black Workers Group and
Corporate Disabled Workers Group. In addition to this we also supplied the
Council's response on the proposed performance indicators. This is also
attached.

Your question regarding self assessment is harder to answer as the Council
adopted all forerunners of the EFLG - the CRE Standards in 1999 and the
LGA Standards in 2004 - and has been self assessing regularly throughout
this period on all equality areas. The evidence for this is on the
Council's website www.nottinghamshire/equalities eg initiatives such as
the EqiA process, learning and development toolkit, Independent Equality
Advisory Groups structure, the Council's Equality Champions, Equality
Scheme and the departmental and Corporate Equality Plans.
In December 2008 key equality officers carried out a self assessment based
on the EFLG and their knowledge of improvement originally measured by the
LGA Standards. This resulted in an action plan that was approved by the
Corporate Equality and Diversity Strategy Group on 5 January 2009. I would
be happy to send this plan to you, but please be aware that this is the
result of many years of self assessment and improvement and not a one-off
response to the EFLG.

The answer to your final question is yes and these discussions are ongoing
with the Head of Performance. The EqIA you refer to is part of the
legislative requirement of all public bodies to equality proof services.
However, the CAA has clearly indicated that it will be assessing the
Councils understanding of the needs of all equality groups in the county.

It will be clear from the above answers that Nottinghamshire County
Council is committed to the new IDeA Framework. It may be worth noting
however, that Councils are under no legal obligation to adopt the EFLG and
could choose to use other tools to measure equality performance and ensure
legal compliance.
