During the last five years how many times has the Local Government
Ombudsman (as a result of investigating a complaint against Essex
County Council) brought to the attention of the council the fact
that a member of Essex County Council staff had misled them, lied
to them or done anything else to hinder their investigation. If
they have what disciplinary action was taken against the
individual(s) concerned by the council.

these issues to the attention of the council. Therefore, there is
no need to look at every complaint file, all you need to do is look
at the monitoring officers records. Assuming of course your

Sorry but I don't accept your view of the situation regarding the
cost or difficulty in supplying the information nor the suggestion
that I need to go through the councils complaints procedure after
this internal review before I can submit a complaint to the ICO.
You should be aware that the ICO has asked other councils to supply
the information requested.
Your suggestion that the council as a whole is not made aware of
such events and records are not kept centrally beggars belief.

Review of refusal to disclose information under the Freedom of Information
Act
Following your request that this matter be referred to our internal
appeals panel, I am writing to advise you of the outcome of their review.
On 31 July 2009, Essex County Council's Information Appeals Panel (`the
Panel') reviewed your request to assess whether Essex County Council
(`ECC') had dealt with your request in accordance with the Freedom of
Information Act; including the application of Section 12: exemption where
cost of compliance exceeds the appropriate limit and the advice and
assistance ECC provided to you as the requester, as detailed in Section
16: advice and assistance.
The Panel considered that the information relating to `during the last
five years how many times has the Local Government Ombudsman brought to
the attention of the council the fact that a member of ECC staff had
misled them, lied to them or done anything else to hider their
investigation. If they have what disciplinary action was taken.' would
indeed take over 18 hours for ECC to locate, retrieve and provide this
information to you. Therefore, the Panel upheld the decision to exercise
ECC's right not to fulfil your request.Â
The factors considered by the Panel before reaching this decision were:
· The cost to ECC to locate, retrieve and provide this
information;
· Any alternatives available to ECC to provide some of this
information so that it would fall within the cost ceiling.
The Panel decided that, in this case, as the information requested is not
in a readily retrievable format, it was not possible to obtain the
requested information within the cost ceiling as the only option to ECC
would be to search through hundreds of files to manually retrieve this
information.
However, the Panel would also like to provide you with some additional
context on how the £450 limit was calculated. At the time of
calculation, 284 complaints had been received over the last 3 years, based
on this figure we have estimated that there would be approximately 475
complaints received over 5 years. Due to the complexity of each complaint,
we have estimated that it would take around 30 minutes to retrieve and
review each complaint file to determine whether they hold information
relating to your request, which would equal approximately 236 hours.
The Panel also considered the advice and assistance provided by ECC to
you, as the requester, and felt that ECC had provided appropriate advice
and assistance, so far as it would be reasonable to expect ECC to do so.
The factors considered by the Panel before reaching this decision were:
· The level of advice from ECC to you, as the requester, in
reducing the scope of your request to fall within the cost ceiling;
· ECC's advice to you with regards to your rights under the
Freedom of Information Act;
Finally, the Panel did acknowledge the length of time taken by ECC to
respond to your second correspondence of 18 February, for which the Panel
wishes to apologise; they would also like to advise you that we have since
made improvements to our internal processes to better log and track
requests for information.
This is the final stage of our internal complaints procedure. The Panel
hopes that your request is satisfied and you understand and accept its
decision. However, if you are still not satisfied, you are entitled to ask
the Information Commissioner to review its decision. You can contact him

obligation (and also under a constitutional obligation for that
matter) to bring these issues to the attention of the council.
Therefore, there is no need to look at every complaint file, all
you need to do is look at the monitoring officers records.

a logical and valid explanation for not doing so you leave me with
no option but to submit a complaint to the ICO.

This response was received to another of my FOI requests but it was obviously meant as a response to this request.
Freedom of Information request: Local Government Ombudsman Investigations
Further to your request for information regarding Local Government Ombudsman investigations in which you asked:
During the last five years how many times has the Local Government Ombudsman (as a result of investigating a complaint against Essex County Council) brought to the attention of the Council the fact that a member of Essex County Council staff had misled them, lied to them or done anything else to hinder their investigation. If they have what disciplinary action was taken against the individual(s) concerned by the Council.
As you may be aware the Information Commissioner has been communicating with the authority with the above matter and the advice that he has given has been followed. We have reviewed the files for the years in which we have a readily accessible record. These number 120. In none of those files was there evidence of any finding that a member of staff had misled, lied or done anything else to hinder the investigation. In addition I confirm that I have spoken to the Monitoring Officer for the time preceding the keeping of that record and he does not recall any such instance either.
We will also be interrogating our case management system manually to identify further cases and ensure that the authority has met the statutory financial limit for the supply of information as set out in section 12 of the Act. I will write to you in respect of those files when the work has been completed next week.
