(3) How many times has the Ombudsman concerned found the council

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Darlington Borough
Council's handling of my FOI request 'LG Act 1974 Part III Section
32(3) notices'.

Said notices are (legal) statutory and as such there is no need to
review your complaint files to collate the information all you need
to do is ask your legal department how many section 32(3) notices
they have served.

You have failed to respond to my request for an internal review in
a timely fashion or at the very least given me an explanation for
any delay. If I do not get a response within the next ten days I
will submit a complaint to the ICO.

Dear Mr. Nunn

Thank you for your e-mail. I sincerely apologise for the lack of
response, this was an oversight on my part.

I am pleased to inform you that your appeal has been upheld. I have
spoken to our Borough Solicitor and she informs me that, as far as she
is aware, we have served five Local Government Act Part III Section
32(3) notices. We have never had a finding of maladministration for
misusing such a notice.

Once again, please accept my sincere apologies for the delay in
providing this response and any resulting inconvenience.
