has your council served on a Local Government Ombudsman.

(3) How many times has the Ombudsman concerned found the council
guilty of maladministration for misusing a Section 32(3) notice.

Dear Mr Nunn,

In response to your request of the 9th October:

(1) I am writing to inform you that this part of your request for information will not be processed. This is because the cost of locating and retrieving the information exceeds the 'appropriate limit' as stated in the Freedom of Information (Fees and Appropriate Limit) Regulations 2004. It is estimated that it would cost £1,000 to comply with your request. In accordance with s.17 of the Act this letter acts as a Refusal Notice. I am able to inform you that Blackpool Council has only served 1 Section 32(3) Notice on the Local Government Ombudsman since April 2008.

(2) The Local Government Ombudsman has not in the last 5 years found the Council guilty maladministration for misusing a Section 32(3) Notice.

If you have a complaint about the handling of your request you may ask for an internal review and you should submit this in writing to: Council Complaint, Blackpool Council, PO Box 50, Town Hall, Blackpool, FY1 1NA.

If you are not happy with the outcome of the review, you have the right to apply directly to the Information Commissioner for a decision. Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Blackpool Borough
Council's handling of my FOI request 'LG Act 1974 Part III Section
32(3) notices'.

A statutory notice is a legal document and as such your legal
department will be able to identify the number they have served one
on the LGO very easily and without undue costs, therefore, I do not
accept costs grounds as an excuse for not providing the
information.
