Dear Sir or Madam,
Over the last five years
(1) How many Local Government Act Part III Section 32(3) notices
has your council served on a Local Government Ombudsman.
(3) How many times has the Ombudsman concerned found the council
guilty of maladministration for misusing a Section 32(3) notice.
Yours faithfully,
Trevor Nunn

Still waiting for a response.

Dear Sir
Your Request for Information from Adur District Council
I refer to your e-mail to Worthing Borough Council of 12 October 2009
asking for
"Over the last five years
(1) How many Local Government Act Part III Section 32(3) notices has
your council served on a Local Government Ombudsman.
(2) How many times has the Ombudsman concerned found the council guilty
of maladministration for misusing a Section 32(3) notice."
As far as I am aware the answers are (1) None and (2) None for Adur
District Council.
I have assumed that the request you sent to Worthing is a duplicate of the
request sent to Adur. I apologise for the delay in replying to your
request. Unfortunately I cannot trace receipt of your original request to
Adur District Council. Nor can I trace your request for an internal
review. If you wish an internal review to be conducted please write to
Jeremy Cook as detailed below rather than going through the intermediary
of a website then your request should reach its destination.
If you are unhappy with the way that this request has been resolved, then
you may ask for an internal review of this decision by writing to The
Executive Head of Legal & Democratic Services (Jeremy Cook) at The Town
Hall, Chapel Road, Worthing, BN11 1HA.
You may also make a complaint under Section 50 of the Freedom of
Information Act to the Information Commissioner, who can be contacted at
Whycliffe House, Water Lane, Wilmslow, Cheshire SK9 5AF. However please
note that he would normally expect that any internal review procedures
have been exhausted prior to contacting him.
This response is personal to you and no consent to publish it, for
instance on a website, is given. Any application for consent to re-use
information will be considered under the Re-Use of Public Sector
Information Regulations 2005, but if consent is given a charge may be made
to you.
Yours faithfully
