Dear Sir or Madam,
Over the last five years
(1) How many Local Government Act Part III Section 32(3) notices
has your council served on a Local Government Ombudsman.
(3) How many times has the Ombudsman concerned found the council
guilty of maladministration for misusing a Section 32(3) notice.
Yours faithfully,
Trevor R Nunn

Dear Mr Nunn
I refer to your request under the Freedom of Information Act dated 9th
October 2009 requesting information on LG Act 1974 Part 111 Section
32(3) Notices. I apologise for the delay in responding to your request
but due to the large volume of requests we are now receiving new
systems and procedures have now been introduced and hopefully this will
prevent anything like this happening again.
a) The Council has a duty to confirm or deny that it holds recorded
information that an applicant seeks from it and a duty to supply the
information requested, subject to any exemption that may apply.
b) However, under the provisions of the Freedom of Information Act
2000 the right of access is to the information and not the documents.
I have consulted with the Complaints and Consultation Officer who
informs me that there have been no notices services on the Local
Government Ombudsman and no occasions of maladministration for misusing
a notice.
If you are dissatisfied with the Freedom of Information response set
out in this letter you are able to utilise the Council’s complaints
procedure, and details of which are enclosed.
In addition, information to any right of appeal to the Information
Commissioner may be found at www.informationcommissioner.gov.uk or by
writing to Information Commissioner, Wycliffe House, Water Lane,
Wilmslow, Cheshire, SK9 5AF (telephone 06125 545745), email
