Dear Mr Bimmler,

Thank you for your request for information which is copied below. I
apologise for the delay with our response.

We can confirm that the information you require is held by the House of
Commons.

The House has concluded that the provision of this information to you
would, or would be likely to, prejudice the effective conduct of public
affairs and your request is refused. The exemption described in section
36(2)(b)(i&ii) and section 36 (2)(c)of the FOI Act (prejudice to
effective conduct of public affairs) applies. The exemption is being
applied because the confidentiality of the House of Commons research
service to the Member of Parliament using it is a fundamental element of
the service's effective operation. Any breach of that confidentiality
would therefore inhibit the free and frank provision of advice and, in
general, be prejudicial to the conduct of public affairs by the House of
Commons. This is an absolute exemption and the public interest test
does not apply.

You may, if dissatisfied with the treatment of your request, ask the
House of Commons to conduct an internal review of this decision.
Requests for internal review should be addressed to: Freedom of
Information Officer, Department of Resources, House of Commons, London
SW1A 0AA or [House of Commons request email]. Please ensure that you specify
the nature of your complaint and any arguments or points that you wish
to make. If the decision to apply section 36 of the 2000 Act in respect
of your request is upheld by review, a certificate signed by the Speaker
may be issued. This certificate would provide conclusive evidence that
the exemption was required for the purpose described above.

thank you for your email. As you will know, section 36 (2)
maintains that the decision to apply this exemption must be made by
a qualified person. Per section 36 (5) (d), the qualified person
for the House of Commons is Mr Speaker. I therefore ask you to
supply me with a certificate as provided for in section 36 (7) as
evidence that this determination has been made by the Speaker.

Concurrently, I request an internal review of my decision.

Dear Ms Turner,

I understand your problem and I acknowledge that staff may at the
moment be quite busy. However, I would still ask you to bear in
mind, that the ICO has ruled in several Decision / Enforcement
Notices / Practice Recommendations that staff shortages (because
staff members are absent or busy with other matters) are not a
valid reason to delay the handling of Internal Reviews
indefinitely. As there are statutory provisions that Internal
Reviews need to be dealt in a reasonable amount of time (which has
been calculated by the ICO and is not influenced by what else the
Public Authority needs to do at the moment), the Public Authority
would need to allocate more resources (ie. personnel, even
temporary personnel if needed) to the completion of the Internal
Reviews, if the usual FOI staff is otherwise occupied.

This is, obviously, also in your interest, as continuous delays in
replying to Internal Review requests will only lead to more
complaints to the ICO (before the Reviews are finished) and thus to
more work for your office at the end of the day.

This said, I hope that you will be able to send out replies to the
internal reviews as soon as possible and look forward to hearing
from you again.
