Legal actions threatened by ODA legal team

Heather Brooke made this Freedom of Information request to Olympic Delivery Authority

The request was partially successful.

From: Heather Brooke

11 May 2009

Dear Sir or Madam,
Under the Freedom of Information Act 2000 I seek the following
information annually for the years since the ODA came into
existence:
1. The number of times legal action of any kind has been suggested
by the ODA's legal team to any outside party or parties.
2. A listing of these instances including date and type of supposed
violation: eg infringement of trademark, copyright infringement,
defamation/libel etc.
3. Copies of communication from the ODA in which legal action was
threatened and the end result (if any).
4. A listing of all cases in which legal action was brought or
settled.
5. If any settlement was made, the costs of these settlements
annually.

Yours faithfully,
Heather Brooke

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Olympic Delivery
Authority's handling of my FOI request 'Legal actions threatened by
ODA legal team'.

A full history of my FOI request and all correspondence is
available on the Internet at this address:
http://www.whatdotheyknow.com/request/le...

I find your answer pedantic in the extreme. You make great efforts
to somehow construe common English words such as 'to' 'by' and
'against' in such a way that you can claim you don't hold the
information I requested. Some might call this a clear example of
willful obstruction.

Do you mean to tell me the ODA holds no records of how often and
against whom it has threatened legal action? I find that difficult
to believe. Particularly when I read on the ODA's own website the
following:
http://www.london2012.com/about/our-bran...

"The London 2012 Organising Committee is obliged to protect the
Games' Marks in order to raise the funds needed to host the 2012
Games. Unauthorised use of the Games' Marks is against the law.

The London 2012 Organising Committee expects that everyone will
refrain from unauthorised use of the Games' Marks. If necessary,
however, the London 2012 Organising Committee is prepared to take
legal action to protect the Games' Marks.

This could include court orders for the seizure of unauthorised
merchandise and the payment of compensation."

I therefore look forward to a substantive reply in the positive.

Yours sincerely,

Heather Brooke

Dear Sir or Madam,
As a follow on to my internal review request I should ask that
under your section 16 duty to provide advice and assistance if you
know of any other body who holds this information instead of the
ODA (which presumably you do as it directly relates to the legal
affairs of the ODA) that you would pass on to me who this
organisation is.
Yours sincerely,

Heather Brooke

Dear Ms Jarvis,
I have recently seen information stating that the ODA has
threatened a blogger with defamation. Please see:

http://www.rjw.co.uk/news-events/directn...

You may recall that two months ago the ODA confirmed to me that it
had never once threatened legal action. Can you please confirm that
the case mentioned above was filed after my request and that it is
the first and only legal action threatened by the ODA.

Yours sincerely,

Heather Brooke

The letter threatening legal action is on the leabank square blog. If this is the information you refer to, it is dated 7th August 2009. I do not understand why it is taking them so long to respond - is there earlier information?

How bizarre! No reply seems to have been received to this request. The story was covered on the Games Monitor website in August 2009 http://www.gamesmonitor.org.uk/node/857
