"Lawful Rebellion" and Understanding Law.

Capt Frantic made this Freedom of Information request to The Law Society

The request was refused by The Law Society.

Dear Sir or Madam,

I understand that this request for information may not fall under
the FoI act 2000 and may be (in detail) information which you can
not (or do not) want to disclose. However, I am sure that you are
keen to comply to the spirit of the FoI act (or your own internal
version of such). With that in mind, could you please address, to
the best of your ability, my following queries.

1) Is Magna Carta, Article 61 still valid and if so can any subject
of Her Majesty enter into a state of "lawful rebellion" (if they
can demonstrate just cause) and become a "Freeman on the Land" by
pleading this Article?

2) What is the legal process that would need to be followed to
facilitate entering into such a state?

3) Is it true that, in law, I, the human being am clearly distinct
from my "person", the legal fiction represented by my N.I. number
and Birth Certificate?

4) Is it true that any legislation, statute or act issued by Her
Majesty's Parliament can only be considered law by the consent of
the governed?

If you are unable to provide this information, could you please
advise me on where to go to obtain such. Please bear in mind that I
am not able to afford a solicitor, I doubt whether I would able to
claim Legal Aid to allow me to gain such information via a
solicitor and that although I have a reasonably good intelligence,
I cannot be expected to spend 10 years studying at my local
library.

I hope you will agree that it is essential for the governed to
understand as far as possible the nature of the system which they
consent to be governed by. I hope you will also agree that the
ability for the governed to dissent is vitally important for any
state as it discourages and ultimately prevents any and all forms
of despotism from usurping the basic freedoms of Her Majesty's
subjects. As such, I am also sure you will understand and agree
that such information should be freely and clearly available to all
of Her Majesty's subjects for, if it were not, then any such
safeguard against despotism might as well not exist at all.

Thank you once again in advance for answering this query and I am
confident that you will do your utmost to comply with the spirit
and ethos of Freedom of Information.

Yours faithfully,

Stephen: of the family Seignot

Dear Mr Seignot,

Thank you for your email.

The Law Society is not a designated public authority under the Freedom
of Information Act 2000 but it has adopted its own voluntary Code or
Practice:

http://www.lawsociety.org.uk/documents/d...

The Code gives the right of access to information held by the Society
subject to certain exceptions. Your questions are not requests for
information held by the Society and are therefore not within the scope
of the Code. The Society regrets that it is not able to provide legal
advice.

Yours sincerely

Dear Information Compliance,

Thank you for your response, however, I find it strange (if not
disturbing) that the Law Society is unable (or unwilling) to answer
queries in relation to issues of legality. I suggest that you are
in danger of appearing to be un-cooperative.

I would be grateful therefore if you could please inform me on
which organisation I would need to contact to get answers to my
queries.

I respectfully remind you that I do not have the money to pay for
this information from a solicitor (indeed this information should
be free) and I have not got 10 years to study and decipher arcane
laws written in legalese. It would be most helpful and appreciated
if you could point me to a suitable source for the information
which I require.

Yours sincerely,

Stephen: of the family Seignot

Dear Information Compliance,

It is regrettable that you were unwilling to respond to my
reasonable request for further information. Subsequently I've
looked at your dealings with other FoI requests on the website,
www.whatdotheyknow.com, and have discovered that uncooperative,
late, unfulfilled and unsatisfactory responses appears to be the
norm for your organisation.

I therefore have no choice but to mark this enquiry as being also
unsatisfactorily resolved, much like the majority of other FoI
enquiries made to you on this website. Quite a track record you
have there.

If you would like to address this issue then please pass this
enquiry on for internal review. Should you then be willing to have
the decency to reply with an offer of advice (as requested) I will
of course update the status of this enquiry to "satisfactorily
addressed".

With regret,

Steve: of the family Seignot
