North Dorset District Council

13 October 2008

Dear Mr. Astin,

The following information is given in response to your Freedom of
Information email request dated 8 October 2008.

The Milldown was acquired by this Council's predecessor by a Conveyance
dated 20 April 1917 made between (1) The Right Honourable William Henry
Berkeley Viscount Portman (Vendor) and (2) The Mayor Aldermen and
Burgesses of the Borough of Blandford Forum (Purchaser). The purchase
price was 250.00.

This land automatically vested in North Dorset District Council on local
government re-organisation in 1974 by virtue of the Local Authorities
(England) (Property Etc.) Order 1973.

The 1917 Conveyance contains the following covenant:-

"The Purchasers hereby covenant for themselves their successors and
assigns that they will not use or allow to be used the said pieces or
parcels of land or either of them for any purpose other than recreation or
play and pleasure grounds and will not erect or allow any buildings or
erections of any description on the portion on the south western side of
the Railway without plans of such erections being first submitted to and
approved by the Vendor his heirs successors and assigns."

This land is now registered at the Weymouth Land Registry under title
DT357695 and described as "land on the north east side of Milldown Road
Blandford DT11 7SH".

Regards,

Alan Fraser.
