Lack of response to previous FOI Requests

Can you explain why I have received no reply to my previous FOI request requesting an Internal Review into why I was denied information relating to Police Officers being withdrawn from Lambeth during Feb 2012?

Why made the decision not to respond to the Internal Review Request and who else was consulted?

In addition if/when will I receive the information requested in my previous FOI Request?

My request for an internal review was made on 30th March 2012.

reference number 2012040000075.  Unfortunately, I have been unable to
complete a full internal review within our target response time of 20
working days.

I anticipate that a full response will be provided to you by the end of
the week i.e. 22/06/2012.

Dear Mr Gentry

The Freedom of Information Act provides a right of access to 'recorded'
information.  Public authorities are not required to create new
information in response to a Freedom of Information Act request.

This is explained in ICO Decision Notice FS50191203 which states at
paragraph 18:
'Set out at section 84, the right of access under the Act is defined as
the right to access recorded information held by a public authority. A
public authority is under no obligation to create new information, provide
general explanations or opinions.'

Section 84 (Interpretation) of the Freedom of Information Act 2000 states:

In this Act, unless the context otherwise requires-

"information" … means information recorded in any form;

Your correspondence dated 16/06/2012 relates to an Internal Review
(ref:2012040000075).

Although this has been entered on the Whatdotheknow.com website as a
separate request, it was received by an MPS mailbox that receives requests
and queries submitted via e-mail in relation to the Freedom of Information
Act.

The content of your correspondence dated 16/06/2012 is asking for an
update and/or general explanations in relation to an FoIA internal review
that was ongoing at the time your correspondence was received.  This
correspondence was treated as an extension of the internal review rather
than as a new FoIA request.  In any case, recorded 'information' was not
held in relation to your request.

You were advised on 18/06/2012 that your request was being considered and
provided with an estimated response date.   No decision was ever taken to
not respond to your request for an internal review.

A response to your request for an internal review has since been provided
to you and I understand that your request is now the subject of an appeal
to the Information Commissioner's Office.

With this in mind, please contact the Information Commissioner's Office if
you have any further concerns regarding the MPS responses to your requests
for information.
