this morning, in a statement dated 27 March 2009, that "In addition
the Chief Constable has requested the National Police Improvement
Agency carry out a strategic level review of the policing of
Climate Camp. This will be conducted by a senior officer from
another force and will involve the consideration of the issues
raised in the report published by the Liberal Democrat party
regarding the overall policing of this event, as well as the
strategy and tactics used in the operation."
I have made a copy of the page, in case it should "mysteriously"
"disappear".
Please provide me with a copy of the reports by the NPIA, which
according to

have been completed and delivered to Kent Police. Please provide
copies of the original report and the revised one.
Please note that "replies" which consist of attachments in
proprietary file formats are not acceptable. A reply which is not
in plain text format will be deemed to be a refusal to answer. It
may well be that it is difficult to render the reports in plain
text. In that case please contact me before replying to agree an
acceptable format for the reports. The rest of the reply does not
need to be

been responded to within the maximum permitted time and thus, once
again, Kent Police are criminals.

Dear Mr. Hansen,
The Freedom Of Information Act 2000 obliges us to respond to requests
promptly and in any case no later than 20 working days after receiving
your request. I am very conscious that we have not been able to respond
within this deadline and I apologise for the delay in providing a response
to your request for information.
Kent Police must consider firstly whether we can comply with Section 1 (1)
(a) of the Act which is our duty to confirm or deny whether or not the
information requested is held and secondly we must comply with section 1
(1) (b), which is the provision of such information. However, when a
qualified exemption applies either to the confirmation or denial or the
information provision and the public interest test is engaged, the Act
allows time for a response to be longer than 20 working days, if the
balance of such public interest is undetermined.
In this case we have not yet reached a decision on where the balance of
the public interest lies in respect of either of the above obligations. We
estimate that it will take an additional 10 days to take a decision on
where this balance lies. Therefore, we plan to let you have a response by
17th May 2009. If it appears to take longer than this to reach a
conclusion, you will be kept informed.
The specific exemption which applies in relation to your request is
Section 31 of the Freedom of Information Act 2000, Law enforcement. I
apologise again for the delay in providing you with a response.

Dear Freedom of Information Freedom of Information,
I have read the long letter which has been provided by Kent Police.
In view of its length it could probably not have been provided as
plain text. I trust the author now feels better. I recommend anyone
who is interested in the attitude of Kent Police towards its
employers, taxpayers like me, to read it carefully.
In reading it people should remember that if Kent Police had
behaved in a respectable and lawful fashion towards the fine
upstanding people attending Climate Camp then I would have not felt
the need to make any enquiries about the camp at all. I do have
other things to do with my time. People working for Kent Police may
believe that they are working for, "an organisation dedicated to
upholding the law", but the actions of Kent Police at the camp
demonstrated that this is debatable.
The letter makes a number of false accusations. It claims that
requests for specific information which should already be recorded
are requests for commentary, a tactic which has been tried before.
It also contains several attempts at attacking my character via
amateur psychology. It even makes the false accusation that I am
trying to harass Kent Police. I will deal with all this in due
course.
For the moment I will limit myself to the following from the
letter, "You retain the right to complain. A member of staff who
has not previously been involved this request will conduct an
internal review of this decision and will endeavour to reply within
20 working days. However, when considering the circumstances, we
are not prepared to accept a request for an internal review via the
means you have employed to date. You may request a review by
writing to:"
The attempt by Kent Police to dictate to one of its employers, me,
how I make my enquiries is I think revealing, but it does not
appear to have any basis in Freedom of Information law as outlined
in

and related pages.
Please let me know on what basis Kent Police thinks it can dictate
how people make FoI enquiries? I can make this as a separate
request if preferred, but given that Kent Police has amalgamated
several of my requests I will ask here. Try not to reply by falsely
claiming that this is a request for commentary. This is an enquiry
about a specific piece of information.

The page linked to in the annotation now contains a link to the revised version of the NPIA report. However, that page did not exist in that form at the time my enquiry was made.
The page does not contain a link to a copy of the initial NPIA report and Kent Police have not provided a copy of the initial report in response to my FoI enquiry.
They have provided a file which claims to show the differences between the two reports. It must have cost their employers, which include me, some time and money to produce that file compared to just providing a copy of the original report.
Someone may like to make an FoI enquiry about how much it cost to produce the file.

Under the FOIA, an authority is not legally required to have an internal
review procedure, but in order to conform with the Section 45 code of
practice an authority should have a review procedure in place.
Details of how to request an internal review have been provided to you in
the refusal notice, as well as contact details for the Information
Commissioner's Office. This is in accordance with the requirements of the
Act. The Code of Practice states that reviews should be carried out in
accordance with the authority's complaints procedure. Therefore details
of that procedure have been provided to you.
