According to

you are conducting an "inquiry" into the oppression by the police
of the fine upstanding citizens attending the climate camp.

There is no information on http://www.npia.police.uk regarding
this.

Please provide:

1) a copy of the terms of reference for the "inquiry".

2) a pen portrait of the careers of those who are undertaking the
"inquiry".

3) a copy of the call for evidence you have made and the names of
the organisations this was sent to.

4) the likely date when the report will be made available to the
public.

Please also note that "replies" which involve attachments in
proprietary file formats are not acceptable. A reply which is not
in plain text format will be deemed to be a refusal to answer.

Dear Mr Hansen,

With reference to your last paragraph in your original request,

"Please also note that "replies" which involve attachments in
proprietary file formats are not acceptable. A reply which is not
in plain text format will be deemed to be a refusal to answer."

The '.pdf' format is an open standard format (ISO 32000-1:2008) so, therefore not a proprietary file format. It has been acceptable to other users of the 'What do they know' website. However, as the answer was not supplied in the format you requested please find attached plain text file response.

Alternatively, you can use the facility on the 'What do they know' website to view the response as HTML.

Dear NPIA Information Desk,

One of the best tips about replying to an enquiry is to read the
proposed response and compare it with the request, making sure that
the request has been complied with or an explanation given as to
why it is not being complied with.

All you needed to do was put the answer in your reply, as I have
done below. You were unwilling to do that.

Not all of us wish to use malware designed to spread infections as
rapidly as possible, malware produced by a large company which
automatically opens attachments. Instead of stubbornly sticking to
the broken ideas of malware suppliers, public organisations would
do well to do things properly.

I have now done what you should have done, put your reply in plain
text format, below.

Dear Mr Hansen,

I am writing with reference to your request for information
regarding Kingsnorth Climate Camp Inquiry, dated 21st December,
made under section 1(1) of the
Freedom of Information Act.

You asked for the following information:
1) a copy of the terms of reference for the "inquiry".

2) a pen portrait of the careers of those who are undertaking the
"inquiry".

3) a copy of the call for evidence you have made and the names of
the organisations this was sent to.

4) the likely date when the report will be made available to the
public.

I am writing to advise you I have established that the information
you requested is not held by the NPIA. The NPIA have been
commissioned by Kent Police to conduct
a structured debrief in respect of the policing of Kingsnorth
Climate Camp. Therefore the answers I have provided are with
reference to this debrief.

1) a copy of the terms of reference for the "inquiry".

The aim of the debrief is to identify best practice and lessons
learned.

2) a pen portrait of the careers of those who are undertaking the
"inquiry".

The debrief is being undertaken by members of Uniform Operational
Support who are trained in structured debriefing. We do not
currently hold a "pen portrait" of the staff involved in the
debrief, these would have to be obtained from their personal files.
However, as this is not a Public Enquiry, any request for this
information may attract an exemption under Section 40(2) Personal
Information.

3) a copy of the call for evidence you have made and the names of
the organisations this was sent to.

There is no call for evidence. All personnel to be debriefed are
members of Kent Police.

4) the likely date when the report will be made available to the
public.

The NPIA currently has no intention to release this document into
the public domain, this will be the responsibility of the Kent
Police once the document has
been submitted to them.

We take our responsibilities under the Freedom of Information Act
seriously but, if you feel your request has not been properly
handled or you are otherwise dissatisfied with the outcome of your
request, you have the right to complain. We will investigate the
matter and endeavour to reply within 3 - 6 weeks.

You might want to clarify your "standard last paragraph" in the next requests... The combination of "Please also note that "replies" which involve attachments in
proprietary file formats are not acceptable." with "A reply which is not in plain text format will be deemed to be a refusal to answer." is in my humble opinion somewhat ambiguous: the first sentence implies, that attachments in non-propietary file formats (such as PDF) are acceptable, whereas the second sentence then rules out everything except for plain text format. Then, I wonder why you even bother to insert the first sentence, as you will clearly only accept ".txt"-files and inline answers anyway...?

There is no one answer to the question of replies. What is appropriate depends on the content.

For nearly all replies plain text is entirely adequate to convey the reply. Plain text does not contain fancy marketing image stuff, like logos, but that is an advantage rather than a disadvantage. A "reply" which simply consists of, "please see the attached document" is not a reply, it is an insult. These people "replied" (to their employer - me) twice with that sort of "reply".

On rare occasions something more than plain text may be appropriate. Tables and drawings are examples. In that situation the organisation should get in touch with the enquirer and ask them what format they would like. That is common courtesy, something missing from many government organisations. One of these formats may be Acrobat, but it should be agreed first rather than assuming that someone wants that format.

Organisations which send Microsoft format documents, many government organisations, are being particularly rude. I do know that Microsoft managed to fool the ISO into accepting a Microsoft "standard", but that just demonstrates how those with lots of money can buy influence. Not the first time, and probably not the last time, money has talked.

Why many government officials appear to be unwilling to reply to an Internet enquiry in the same format that it was sent is a mystery, but it does I think tell us something about their attitude. Do they reply to enquiries sent by letter with text messages? I imagine not.

David,

I understand your frustration. The NPIA is one of a dwindling number of public sector organisations that still routinely publishes most of its important documents (e.g. job descriptions, person specifications, etc.) on its Web site in Word .doc format, with everything that this entails (a few are in .pdf files, for which at least one can obtain reader software for non-Microsoft operating systems).

However, if you want to know why this is, you only need to look at my FoI request about the costs of an NPIA drinks reception and "Gala Dinner", of which Microsoft is one of the main sponsors. Moderators: This is not a rant, merely an objective note to draw attention to this organisation's failure to properly use open standards and the Web as an open information publication medium.
