Dear Ms Brown,

Apologies for the delay in responding to your recent Freedom of
Information Act requests this was due to the fact that your request
emails got caught in the Councils spam email filtering tool. This
delayed the requests from being able to be actioned.

Please find below our response to this request.

With regard to your questions relating to Job Seekers Allowance I should
advise you that the Council has no responsibility for administering Job
Seekers Allowance and therefore don't hold the information that you have
requested. I would suggest that you refer your query to the Department
for Work and Pensions who are the responsible body for Job Seekers
Allowance (http://www.dwp.gov.uk/foi/#foi6).

In relation to your question on "What steps to you take to stop EU poor
claiming benefits from Lambeth Councils?" we can only answer this
request in relation to Housing Benefit and Council Tax Benefit, as these
are the only two benefits that the Council has responsibility for
administering.

In relation to these two benefits all claimants are asked when making a
claim, if they have 'come to live in the United Kingdom, the Republic of
Ireland, the Channel Islands or the Isle or Man in the last five years'.
They are also asked their nationality. Claims cannot be assessed
without this information. The information and evidence of identity
provided to support the claim is used to establish their entitlement to
UK state benefits in line with current European law, British law, the EC
treaty, regulations and directives.

You have also asked "If a poor family comes from EU ask for housing
which they are not entitled to what action do you take?"

If the family are from an EU country (and are therefore not subject to
immigration controls) then they are entitled to register on our Housing
Register. They information they provide will be assessed to establish
there housing register points. If they are not entitled to housing then
they will be written to and the reasons for their ineligibility will be
explained.

I hope that the above information is of use to you. Should you be
dissatisfied with the way in which your Freedom of Information request
has been dealt with you can request an internal review by emailing:
[email address] (Please quote the reference number above) or
by writing to:
