Kent County Council
16 June 2009
Dear J Cassidy
Thank you for your request for information
Your request for minutes has been discussed with other Authorities
represented at the Joint Council meetings, and the conclusion reached is
that disclosure would discourage member Authorities from free and frank
discussion, and so undermine the viability of this strategic
forum. Accordingly, it is the opinion of Kent County Council's Monitoring
Officer that this information should be withheld under Section 36 of the
Freedom of Information Act, as disclosure is likely to prejudice the
effective conduct of public affairs.
Section 36 requires consideration of where the public interest lies, and
it is KCC's opinion that it would not be in the best interests of the
public for this forum to be undermined by the reluctance of member
Authorities' representatives to engage in free and frank discussion.
Furthermore, it is felt that disclosure of data provided by
individual Authorities may be detrimental to community
relations, particularly in view of the vulnerable nature of UASC
(unaccompanied minors) and other BME groups.
In addition to the meeting minutes already provided for ADASS/ADCS Asylum
Task Force under your previous FOI request (reference FOI/09/272 )
please find attached agendas, attendance list, terms of reference and 'No
Recourse to Public Funds: Financial Implications for Local Authorities'
which can also be found at the attached link to the ADASS website with

If you disagree with this stance, you can appeal direct the Information
Commissioner, who oversees compliance with the Freedom of Information Act
2000. This is because there is no-one sufficiently senior within the
Authority that could conduct an independent internal review of this
decision which was made at the highest level. Details of what you need to
do, should you wish to pursue this course of action, are available from
the Information Commissioner's website .

Dear Sir or Madam,
Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Kent County Council's
handling of my FOI request 'Joint Council meetings minutes'.
A full history of my FOI request and all correspondence is

Dear J Cassidy
Thank you for your email.
I am sorry you are unhappy with the Council's response to your request for
information, specifically the use of the prejudice to the effective
conduct of public affairs exemption under section 36 of the Freedom of
Information Act to withhold minutes of the "Joint Councils" meetings.
Given that all members of staff that are qualified to undertake internal
reviews under FOIA are subordinate to the Director of Law & Governance
(KCC's Monitoring Officer) who invoked this exemption, and are therefore
unable to conduct an independent and impartial review of your request, you
can appeal directly to the Information Commissioner, as I advised in my
original reply (copy attached). The Information Commissioner will
consider your complaint given these circumstances, even though an internal
review has not been conducted. Details of what you need to do, should you
wish to pursue this course of action, are available from the Information
Commissioner's website

send them to me in the original format, as I requested in my

Dear J Cassidy
If you want copies of the documents provided 16th June (see attached) in
their original format, you will need to approach the local authority that
generated them. I would remind you that the Freedom of Information Act
2000 provides you with a right of access to information, not necessarily
the original documents that the information you requested is contained
within.
The Asylum Taskforce agendas for 10/11/08 & 12/2/09 and the attendance
list were issued by the London Borough of Hillingdon and the Asylum
Taskforce TOR was issued by Birmingham City Council.
The NRPF Financial Report is a publicly available document so is only held
in pdf format.
If you remain unhappy, you can appeal direct the Information Commissioner,
who oversees compliance with the Freedom of Information Act 2000. This is
because there is no-one sufficiently senior within the Authority that
could conduct an independent internal review of the original request.
Details of what you need to do, should you wish to pursue this course of
action, are available from the Information Commissioner's website .

Dear Sir or Madam,
Thank you for taking the time to respond. I am very puzzled by the
attitude you are conveying with this request, concerning the
accessibility quality of the disclosures you have made. Please
advise whether Disability Discrimination Act concerns do or do not
apply to Kent County Council? Please advise me on whether or not
you have also considered my request under Section 11 of the Freedom
of Information
Act 2000?
Would it not have just been a courtesy not to have converted
documents you hold from MS Word to PDF. For instance the document
you sent me:

was actually converted from MS Word to PDF on 16/06/09. If you care
to look in the Document properties meta data you will see you
