Good Afternoon,
Thank you for your request for information below. The contents of the
three reports of investigations into allegations against the Headteacher
are confidential. To disclose them to a third party would be a breach
of confidence and also contravene the provisions of the Data Protection
Act 1998, which require all processing of personal data to be made
fairly and lawfully.

The reports are therefore exempt from disclosure under the Freedom of
Information Act 2000 and your request is refused. The sections of the
Freedom of Information Act 2000 that the Council has relied on to refuse
your request is Section 40 (2) and Section 41.

Requests for the personal data of a third party (someone other than the
applicant) are exempt under section 40(2) of the Freedom of Information
Act if disclosure would breach any of the eight Data Protection
Principles.

Furthermore, in most cases, personal data will be exempt if disclosure
would be 'unfair'. Disclosure of personal data relating to a third party
will often breach the fair processing principle if there was a
legitimate expectation by a third party that this information would
remain confidential.

You have the right under Section 17 of the Freedom of Information Act
2000 to ask for an internal review of the refusal to supply the
information requested. Please would you direct any request for an
internal review to Mr Surjit Tour, Head of Legal and Member Services,
Department of Law, HR and Asset Management, Town Hall, Brighton Street,
Wallasey, CH44 8ED

You do have the right to complain to the information Commissioner, if
you are dissatisfied with the outcome of any internal review.
