Dear Manchester City Council,

1) Please supply information relating to the incidence of attempts
by care providers to evict residents in care homes - that is, care
providers giving residents notice to leave or otherwise attempting
to get them to leave without their involvement in the decision or
against their wishes.

Please indicate the number of cases you are aware of for the last 3
years, also indicating if and how your council responded to the
situation, and what was the ultimate result of the sitaution, i.e.
if and how the situation was resolved.

2) Please provide me with the number of instances your council is
aware of where either CQC or local authority safeguarding
procedures have substantiated allegations of insitutional abuse of
a Leonard Cheshire social care service user over the past 3 years.

Further, please provide anonymised information on the alleged
behaviour by Leonard Cheshire resulting in the conclusion.

Dear Manchester City Council,

Please pass this on to the person who conducts Freedom of
Information reviews.

I am writing to request an internal review of Manchester City
Council's handling of my FOI request 'Institutional abuse and
Evictions of Care Home Residents'.

The request has gone beyond the 20 working day limit for responses,
and I have had no progress report or anything, despite sending a
chasing email.

Please accept my apologies for you not having received a response to your
request under the Freedom of Information Act regarding the above. I am
working through a large backlog of emails and accept full responsibility
for you not having received a response. I have emailed the officers whom I
believe should be able to answer your query if the City Council does
indeed hold this information in a form in which we will be able to supply
without exceeding the cost limit to respond. I will meet with these
officers on Monday to ascertain whether we will be able to provide you
with the information you have requested.

Dear Mr Paulley

Firstly may I repeat my apologies for the delay in supplying you with a
response to your request for information under the Freedom of Information
Act (FOIA). We have reviewed the arrangements for handling Freedom of
Information Act requests and in future such requests will be processed by
our Information Development Manager. This will enable responses to be
issued more promptly and within timescales. I am sorry, however, for any
inconvenience caused by the delay in responding to your query.

In answer to your questions, I can report "care home A" evicted all
residents to turn the home into a drugs and alcohol rehabilitation unit.
This was turned down for planning reasons, the residents were rehoused and
the home currently has no contract with the Council.

There is currently a potential eviction at "care home B" because the
resident's family have caused numerous problems in the home, upsetting
staff and management. Care management are working with the family to
resolve.

There was a potential eviction at "care home C", again due to the
behaviour of a family member, but Deprivation of Liberty Safeguards and
safeguarding procedures are being taken against the resident's family
member to address this.

We have 6 Leonard Cheshire Homes on our list of homes. We have only 2
current placements funded by Manchester. There have been no logged
complaints or safeguarding issues at these homes over the period requested
involving these Manchester placed residents.

Once again may I repeat my apologies for the delay in responding to your
request. I hope, however, that this response is sufficient for your
requirements. If, however, you require any clarification on the points in
this response or would like further information, please do not hesitate to
contact us.
