Dear UK Border Agency,

With regards to the HSMP Forum judicial review (settlement in the
United Kingdom) judgement, I would like to request for a written
confirmation on the date when my initial application to the HSMP
was made.

The above requested confirmation is required to be submitted with
my application for settlement in the UK under the terms of the HSMP
indefinite leave to remain (ILR) judicial review policy document.

Please can you provide me with details on how and where i can get
the above confirmation date?

Dear Ms Tioe,

It is not possible to provide personal information under the Freedom of
Information Act, but you can make a Subject Access Request under the
provisions of the Data Protection Act 1998. There is more information on
how to make a Subject Access Request on the UKBA website - if you click
on the Freedom of Information Act link at the bottom of the page and
then click on the "Personal Data Requests" link halfway down the next
page.

You need to access the UK Border Agency webpage, there is a link in the
blue band at the bottom of the page for Freedom of Information.
Alternatively type "Freedom of Information" in the search box in the top
right hand corner, open the first document "Requests under the Freedom
of Information Act" and the personal data requests link is in the fourth
paragraph.

I had applied to Croydon office under FOI giving my all details.( £10 fees)
They have responded and have also supplied me photocopy of original envelope, I had sent with postage date on it.
I am sure they will do the same for you if you ask.

Hi PS,

Thanks for the information.

I didn't have to submit any confirmation letter on when my initial HSMP application was received by the Home Office. They have all my details in their system and it is not stated in the ILR form that it is required.

My cover letter for my HSMP was dated "March 2006" and I'm certain my application had a date in March as well. However, I believe I may have sent in the application on the 6th of April.

The statement from UKBA states "If you made your initial application for an HSMP approval letter before 3 April 2006, you are eligible to make an application for indefinite leave to remain (ILR) under the HSMP Forum (UK) Ltd High Court judgment of 6 April 2009, even if you did not receive the letter or subsequent leave to enter or leave to remain until after this date."

So the question is, do I fit the criteria for HSMP Forum judicial review? Which date do they use?

April, you mentioned they did not ask for proof - what is the date of your approval letter? Were you in a similar scenario as me?

Hi Peter,

The date is when HO receive your initial HSMP application. I called up HO and asked them for the date when they received my application. You should try that too.
