Information request in relation to the rule of bias for judges.

Derek Canning LLB [HONS] (Account suspended) made this Freedom of Information request to House of Commons

House of Commons did not have the information requested.

From: Derek Canning LLB [HONS] (Account suspended)

12 May 2009

Dear Jack Straw MP.

Reference; Information request in relation to the rule of bias for
judges.

Could you please supply the following information or refer this
letter to the government body that can supply the following
information on my behalf?

Can you please supply the guidance that you or anyone else gives to
judges or judges should know and act on in relation to Nemo Judex
In Parte Sua Latin: no person can judge a case in which he or she
is party or in which he/she has an interest [Frome United Breweries
Co. v Bath 1926 AC 586]

For example what guidance would a Court of Appeal judge have to
follow if he or she not only was a member of the RSPB but worked
for the RSPB watching wild peregrine falcons nest sites and the
case he or she had considered involved the RSPB accusing a man of
illegally taking wild peregrine falcons of the very same type he or
she worked for the RSPB protecting from being illegally taken. I am
particularly interested in the information that relates to if the
judge with the potential bias should act straight away by stepping
down from the case before he put any input into the discussing the
case and therefore potentially influencing the judgement and
setting a precedent for anther cases to follow. I have tried to
make my request for information simply so please give me a detailed
disclosure that is on point only of the information requested.

Yours faithfully,

Derek Canning LLB[hons]
