Independent to stand for Maidstone South in the 4th June 2009
County elections.

Dear S Davis

Thank you for your request for information.

Kent County Council can confirm that a person called Fiona Garland did
propose Sheena Williams, the Independent candidate. However we cannot
ascertain from the information held whether she is the wife of Christopher
Garland, the Conservative Leader of Maidstone Borough Council or even if
she is related to him in any way.

Further information about the forthcoming County Council elections is

The election process is managed by the District Councils in Kent so even
though the elections are for County Councillors, they may hold more
information than KCC does. Consequently, you may want to approach
Maidstone Borough Council if you have not already done so.

Thank you for your reply and quoting:

Would not the address given by the proposer show if the Leader also
received his voting form at the same address, which would verify
the position.

Dear S Davis

Thank you for your request for information.

Kent County Council does not hold or maintain the electoral register, this
is a function of District and Borough Councils in Kent, and KCC has no
more right of access to it than a member of the public. Therefore we do
not know what address the Leader of Maidstone Borough Council's voting
forms would have been sent to and whether this address is the same as that
of the person who proposed the Independent candidate for Maidstone South
in the recent County Council elections. To reiterate what was suggested in
our 22nd May response to your original request on this subject, you should
therefore redirect your request to Maidstone Borough Council who may hold
the information you require.

The Council would like to forewarn you that future requests for
information on this subject will be refused. The Council believes that the
volume, extent, frequency and repeated nature of your requests, and
the inevitable follow-on queries and complaint to the response, has now
become such that your correspondence is taking up a disproportionate
amount of time and public resources to respond to. This is manifestly
unreasonable and could be construed as obsessive and a deliberate attempt
to disrupt the Council's operations. The Council has no obligation to
respond to requests that are perceived to be vexatious under section 14 of
FOIA and it is considered that collectively, your requests are vexatious.
Although your requests are not necessarily "repeated" in the sense that
they are requests for the exactly same information, when taken together
they form a pattern of obsessive requests of a similar nature such that
the Council may reasonably regard as vexatious. Neither the FOIA, nor
scarce public resources, are intended to be used in this way and,
accordingly, no further correspondence will be entered into in response to
your requests for information on these or related topics.
