Incorrect Ring Sizes on SI1220

Dear Department for Environment, Food and Rural Affairs,
Please can DEFRA confirm that under the wildlife and countryside
act 1982 and on SI1220 a list of ring sizes for schedule three
birds which have to be rung with to allow them to be legally sold
or shown.
Chaffinch ring size 2.7mm and Bullfinch 2.5mm.
I believe SI 1220 this is law.
Please could you tell me at the moment Bullfinches are rung with
2.7mm rings are these birds legally rung and if so why?
Please could you tell me if I ring chaffinches with a 2.7mm ring
and the ring is too big for the bird’s leg can I still legally sell
and show the chaffinch because the ring complies with SI1220?
Can DEFRA/Natural England confirm that the above rings sizes are
law and have not been legally changed?
If I understand correctly the ring sizes for the chaffinch 2.7mm
and the Bullfinch 2.5mm are the incorrect size for these birds.
Can DEFRA/Natural England please tell me how long have they be
aware that these ring sizes have been incorrect and if the above
birds are rung incorrectly why have DEFRA/Natural England allowed
these birds to be sold and shown?
Please could you not ask me to take legal advice on this matter I
believe it is for you to answer and you have your own legal
department that could answer the questions?

Thank you for your enquiry regarding SI 1220 1982. The following ring
sizes apply in relation to section 6(5) of the Countryside and Wildlife
Act 1981 (WCA 1981), and birds listed on Part 1, Schedule 3 of the Act.

The above schedule, from the 1982 No 1220 Wildlife and Countryside
(Ringing of Certain Birds) Regulations 1982, therefore sets out the legal
requirement for the ring sizes to be used in relation to Part 1, Schedule
3 birds of the WCA 1981. The ring sizes listed in this Schedule of the
1982 Regulations have not been subject to amendment.
Defra and Natural England are aware concerns have been raised regarding
the implementation of SI 1220 1982, including concerns about the sizing of
rings under the Regulations. The Department is therefore considering the
concerns that have been raised in order to decide what, if any, amendments
may be required. The Department made the following statement on its
website on 17 November 2009,

Where birds are not rung in accordance with the sizes on Schedule 2 of the
1982 Regulations the offences in Section 6(5) of Part 1 of the Wildlife
and Countryside Act may apply.

Thank you for your reply i have asked specific questions please
could they be answered the information you have supplied so far i
am fully aware of i just need clarification on the questions below
which i have already asked.
