May I apologise on behalf of the Council for the delay in replying.
Your request has been dealt with under the terms of the Freedom of
Information Act 2000 and the answers to your questions are detailed below:
We can confirm that Derbyshire County Council did not respond to the 2^nd
questionnaire for the Badman review, so there is no recorded information
held.
I note that per your correspondence of 13 November 2009, you had asked for
an internal review. I have conducted the same and concluded that the
Council has failed to comply with the Freedom of Information Act 2000 on 2
counts:
1. It has failed to comply with Section 10(1) of the Act in failing to
provide its response within 20 working days as prescribed
2. The Council further failed to comply with the spirit of the Code of
Practice prescribed by the Secretary of State under s45 of the Act in
failing to conduct a review of the request promptly or within a
reasonable period of time.
I hope that this now meets your request.
If you are not content with the outcome of this response or my internal
review, you have the right to apply directly to the Information
Commissioner for a decision. The Information Commissioner can be
contacted at: Information Commissioner's Office, Wycliffe House, Water
Lane, Wilmslow, Cheshire, SK9 5AF.

Dear Jain,Rajat (Corporate Resources),
thank you for this final response.
This concludes my analysis of the original 25 self selecting Local
Authorities which were used to collect data for the Badman Review.
Of the 25 Local Authorities;
One refuses to answer
One claims they did not fill in the questionnaire (Derbyshire)
two did not actually fill in the number of safeguarding cases nor
number of safeguarding implications/concerns.
A further 2 LAs did not fill in questionnaires but rather discussed
matters by phone.
One LA did not fill in the questionnaire but rather was the pilot
LA - same questions different format.
That is a total of 21 Local Authorities maximum (if indeed
Wolverhampton did take part-they refuse to answer and this number
includes those who answered by telephone or different format)
Therefore the sample size was of 14% of Local authorities and
covered roughly 25% of the entire EHE population known to all
English Local Authorities.
