Dear Sir or Madam,
Under the FOI Act 2000, I would like to know how many teachers, and
Head Teachers have:

1) Signed a compromise agreement since September 2004.
2) How many of these resulted in the termination of their
employment with yourselves, the council.
3) How long they had been working for the Educational Service in
your Council.
4) How old they were on their day of leaving.
I would be grateful if you could let me know if there is a cost to
this request.

In you reply dated 5th November, you stated you would consider my
request within the statutory 20 working days and you asked me to
quote a reference number, but you did not allocate me one. The
statutory 20 days was today, the 3rd Dec.

I am writing to request an internal review of Croydon Borough
Council's handling of my FOI request 'How many compromise
agreements have been signed by teachers and Head teachers with a
result of these members of staff losing or leaving their jobs since
Sep 2004.'.

Dear Ms MacArthur

Thank you for your email dated 4 November 2009 requesting among other
matters, how many teachers, and head teachers have signed a compromise
agreement since September 2004. We have considered your request under the
terms of the Freedom of Information Act 2000, and apologise for the delay
in replying. Below is our response.

1. How many heads signed Compromise Agreements since Sept 2004?

12 Headteachers

2. How many resulted in termination of employment?

All

3. How long had they been working in the education service?

The information you have requested have been archived and the cumulative
time it would take Council officers to provide the information would
exceed the "appropriate limit". The appropriate limit has been specified
in the Freedom of Information (Fees and Appropriate Limit) Regulations
2004 and for local authorities it is set at £450. This represents the
estimated cost of one person spending 2½ working days in locating,
retrieving and extracting the information from where it is stored. Under
Section 12 of the FOIA the Council is not obliged to comply with your
request and we will not be processing this part of your request further.

4. How old were they on their day of leaving?

Same as 3 above

If you are dissatisfied with the way the department has handled your
request under the Freedom of Information Act, you may ask for an internal
review. You can do this by outlining the details of your complaint and
either

Dear Mr Derby,

I am sorry to hear that you were unwell and hope that you are now
better.
Thank you for your responses above. I am not clear as to the answer
of numbers 1 and 2.
How many teachers? Is the answer 1 teacher?
How many Headteachers? Is that 2?
Please could you confirm or correct me please.

I would like to re affirm that I wish to ask for an Internal Review
as stated in my email dated 3rd December.
The reasons are that I believe that the statistical information is
important.
There are wider implications depending on the length of service and
the ages of the member of staff in these cases - which in my view,
is of interest to members of the public.

Other Boroughs, have given me detailed responses to these two last
questions (numbers 3 and 4) all without asking for a payment as I
believe the research falls within a normal time scale for your
research team.

I am writing to request an internal review of Croydon Borough
Council's handling of my FOI request 'How many compromise
agreements have been signed by teachers and Head teachers with a

Sep 2004.'.

Because I have not had a reply to my last request, the only point I
would like answered by the Internal Review is the following one
which I sent on 15th December, in response to your reply dated the
same day.

I am not clear as to what your figures mean (your email 15th Dec)
and therefore could you confirm or correct my understanding which
is;

Number of Teachers: 0
Number of Headteachers: 12

Dear Ms. MacArthur,

Further to my email to you dated 27 December, 2009, regarding the Internal
Review of this Council's response to your request for information on
compromise agreements, I am now in a position to reply to you.

On receiving your request for a review, I made further enquiries regarding
the information that you had originally requested in questions 3 and 4
below:

3. How long had they been working in the education service; and

4. How old were they on their day of leaving.

I have been informed that that of the 12 previously identified agreements
only 6 are directly held by the by the Council, the others being held by
the schools themselves. Following the members of staff leaving, in line
with the Council's normal procedure these records were archived off site
in secure storage. Following my enquiries I am satisfied that the
cumulative cost of locating, retrieving and then returning these files
will be in excess of the appropriate amount. As stated previously this is
specified in the Freedom of Information (Fees and Appropriate Limit)
Regulations 2004 and for local authorities it is set at £450. Therefore
under Section 12 of the FOIA the Council is not obliged to comply with
your request and we will not be processing this part of your request
further.

If you are not content with the outcome of the internal review, you have
the right to apply directly to the Information Commissioner for a

I appologise for reopening this issue, but somehow, I said on 27th
Dec 09 that you answered 'How many teachers have signed a
compromise agreement since 2004' but in fact this has not been
answered.
I go back to my original points for clarification.

Am I to understand that;

1) Number of Teachers signing a Comp. Agreement since 2004 was: 0
2) Number of Heads signing a Comp. Agreement since 2004 was 12.

or, is the figure 12, a combined number for both teachers and
Heads?
