Can you please tell me how many alley gating scheme applications
were made to CBC and of those how many were successful and how many
were rejected in each of the years 2005, 2006, 2007, 2008, 2009 and
2010.
Can you also please tell me how many alley gating schemes currently
remain outstanding.

I am writing in response to your request for information under the terms
of the Freedom of Information Act 2000, Ref No FOI/10/023
Prior to 2008/09, the data on requests received was not kept, and only
information about schemes that met the criteria was recorded. Therefore
there are some gaps in the information.

2008/09 No of requests - 108
Successful requests - 11
Rolled forward - 48
2009/10 No of requests - 117 (i 48 from 2008/09 and 69 received in
2009/10)
Successful requests - 10 funded, 8 completed
Rolled forward - 35 (3 of the above 48 were dropped as they are adopted
roads
The 69 received in 2009/10 need to be collated into schemes for
consideration and funding in 2010/11.
At present there are 104 outstanding schemes, either to be considered or
implemented.

Dear foi,
Thanks for the information provided.
Given that the alley gating scheme has only run for 5 years, the
fact that you have such basic information missing for 3 of those
years is somewhat incredible.
How can this happen?
How can the Council properly plan and monitor it's progress?
How can the Council claim 'better outcomes for people' when key
data to support that claim is unavailable?

Dear Mr Robinson
I am writing to inform you of the findings of the Internal Review relating
to FOI/10/023, held on 10 February 2010.
The Internal Review panel found that the process of dealing with the
request was sound, and that the information disclosed is the only
information held by Chorley Council.
For the years 2005/2006 to 2007/2008, the administration of the scheme was
controlled by an external agent and therefore Chorley Council does not
hold documents or information relating to this period. The data and
information given about the schemes selected in 2005 to 2008 is based on
information held from officer anecdote. This only relates to the schemes
in place and not on any decision making process. It would appear that all
appropriate proposals were funded during this period.
Since 2008 a robust and documented evaluation process has been in place
and records for these evaluations are maintained on a database and schemes
going forward are recorded on an electronically held spreadsheet.
For the last two years a matrix of the proposed schemes is drafted and the
schemes selected on the agreed criteria to go ahead circulated to Members
via email for comment, questions or challenge. There are no retained
records of any responses from Members since all the schemes selected were
not challenged.
I trust this provides a fuller picture of the records that were used to
respond to the original FOI request.

Dear Mr Robinson
The external agent responsible for collating the information from 2005 -
2008 was called Jeanette O'Brien. However, as an individual and not a
company, any further information regarding Jeanette is personal
information and that releasing it could breach the Data Protection
Principles. It is therefore potentially exempt from release under section
40 (2) of the Freedom of Information Act. This is an absolute exemption.
The first data protection principle requires information to be processed
fairly and lawfully. The Council believe that it would not be fair to
disclose this information. It is gathered under statutory powers and
individuals are not advised that it will be made available to third
parties. For that reason your request for any further information is
refused insofar as it relates to details regarding an individual.
The first data protection principle also requires at least one of the
conditions in schedule 2 to the Data Protection Act to be met before
information is processed. The Council has considered the schedule 2
conditions and believes that the only potentially relevant condition is
condition 6. This allows for the processing of personal data where:
"The processing is necessary for the purposes of legitimate interests
pursued by the Data Controller or by the third party or parties to whom
the data are disclosed, except where the processing is unwarranted in any
particular case by reason of prejudice to the rights and freedoms or
legitimate interests of the data subject."
It is the Council's view that the interests of Jeanette would be
significantly prejudiced if the information were to be released.
Individuals also have a legitimate interest in retaining privacy in
relation to their personal business. This interest is outweighed by any
interest of yours or any other person and for that reason your request is
refused in relation to further information.
