Thank you for your e-mail. Your original request was not answered as
we have been awaiting your clarification since October 2008. However
your request has been allocated a new reference number, and will now be
considered. We aim to provide a response within the statutory timescale

Information reviews.

I am writing to request an internal review of Dyfed Powys Police's
handling of my FOI request 'Homophobic hate crimes reported to
police'.

I am requesting this internal review because it is unacceptable
that my request, which I made 5 months ago, has now been rejected
because the police force does not have the time.

This request was made under the terms of the Freedom of Information
Act, and Dyfed Powys have continually broken the regulations of
that act.

Please complete the review within the time specified by the
legislation and please send me the information I requested in
October 2008 as soon as possible.

Dear Mr Henderson

I acknowledge receipt of your e-mail dated the 18 March 2009 and received
today the 19 March 2009 requesting that Dyfed Powys Police review the
handling of your request 'Homophobic hate crimes reported to police".

My understanding of the issues you have raised are that you consider that
the Force has rejected your request because "...the police force does not
have the time" and that you find this unacceptable.

Your request for a review will be passed to the relevant person that
conducts such reviews and every effort will be made to have a response to
the review to you by the 19 May 2009 however if it becomes clear that the
review will not be completed by this date you will be contacted. In the
meantime we will continue to process your request and we aim to provide
you with a response to your request as soon as possible.

It was necessary for the Force to close your original request of the 24^th
October 2008 as we had not received a response for our request for
clarification within three months; your request was therefore closed on
the 26 January 2009. However following your clarification e-mail of the
18 February 2009 we commenced the request process again. However
unfortunately it has not been possible to provide you with a response
within the statutory time limit due to the volume of Freedom of
Information requests the Force has received which has created a backlog of
requests awaiting action by the FOI Unit. May I apologise on behalf of
the Force for any inconvenience caused.

If you wish to discuss this matter prior to Dyfed Powys Police' response
please contact me.

I write in connection with your request for information dated and received
on the 18^th February 2009 regarding homophobic hate crimes reported to
the police.

Your request for information has now been considered and firstly I am
obliged under s1 (1) (a) of the Freedom of Information Act (FOIA) 2000 to
tell you whether the information is held by the Force. Please see the
attached response document which indicates what information is held by the
Force and the exemptions applied concerning the non release of the
information in whole or in part.

In relation to the first part of your request, the information sought is
provided in the attached response

However where exemptions have been applied, Section 17 of the Freedom of
Information Act 2000 requires Dyfed Powys Police, when refusing to provide
such information (because the information is exempt) to provide you the
applicant with a notice which: (a) states that fact, (b) specifies the
exemption in question and (c) states (if that would not otherwise be
apparent) why the exemption applies.

The following exemption has been applied to all the information you have
requested in relation to the second part of your request.

Section 12 - The cost of compliance exceeds the Appropriate Limit

The cost of providing you with the information is above the amount to
which we are legally required to respond i.e. the cost of locating and
retrieving the information exceeds the "appropriate level" as stated in
the Freedom of Information (Fees and Appropriate Limit) Regulations 2004.
It is estimated that it would exceed 18 hours (i.e. minimum of 20 hours)
to comply with this part of your request. The regulations can be located @

It has been calculated that there are 80 records held which may contain
information applicable to the request. In order to retrieve and collate
the information requested would require opening and researching each and
every record. Going on the estimate that it would take a minimum of 15
minute to research each record, to complete the task would take a minimum
of 20 hours.

Accordingly, applying the same principle the following time estimates have
been calculated for the following years:

In 2007 there were 17 records x 15 minutes = 4.25hrs

In 2006 there were 35 records x 15 minutes = 8.75hrs

In accordance with the Freedom of Information Act 2000, this letter acts
as a Refusal Notice for this part of your request. However, you may wish
to refine and resubmit your request so that it reduces the time shown
above to fall within the 18 hours. Please contact me if you would like
some advice on refining your request.

I would like to take this opportunity to thank you for your interest in
Dyfed Powys Police. I would also like to apologise for the delay in
responding which has been due to the volume of requests received and the
workload associated with those requests.
