In reply to your request for information under the Freedom of Information
Act 2000, dated 24th October 2008 which was received in Cambridgeshire as
follows:
Could you please inform me of
[1a] the total number of homophobic hate crimes reported to you in
the last year
[b] the last three years
[2a] the total number of those hate crimes that were reported to
the Crown Prosecution Service in the last year
[b] the last three years.
We have completed all searches within Cambridgeshire Constabulary and
hereby advise you of our decision.
In respect of question 1[a] and 1[b] we already publish information about
this on our website.
Decision
Pursuant to the provisions of Section 21 of the Freedom of Information Act
2000 (the Act) I have decided to refuse access to the information you have
requested.
Reason For Decision
Section 21 of the Act provides:
Information which is reasonably accessible to the applicant otherwise than
under section 1 is exempt information.
For the purposes of subsection (1), information which is held by a public
authority and does not fall within subsection (2)(b) is not to be regarded
as reasonably accessible to the applicant merely because the information is
available from the public authority itself on request, unless the
information is made available in accordance with the authority’s
publication scheme and any payment required is specified in, or determined
in accordance with, the scheme.
The information you have requested is available from Cambridgeshire
Constabulary’s Publication Scheme.
To access the Publication Scheme please visit our website at
www.cambs.police.uk. The information you require can be found from the
Home page above and click on the 'About Us' link on the left-hand side of
the page; from the following page locate and click on the link entitled
'Your right to information', then 'disclosure log' and finally locate the
2008 log for the month of Nov in the middle of the page. You will find
the information required towards the end of the document entitled
"Recording of Homophobic Crimes and Incidents" which was published on 27th
November 2008.
In respect of your second question, I provide the following in response:
2. The total number of hate crimes reported to the CPS during the financial
year April 2007 to March 2008 was 69 incidents. For the same period in 2006
to 2007, the figure was 68 and for 2005/06 the figure was 58.
We apologise for this response being outside the 20 working days specified
by the Act.

which sets out your rights to appeal.
