Thank you for your recent request under the Freedom of Information Act
2000 which was received in this office on the 24th October 2008.
The information that you are seeking is in relation to the following:
Dear Sir or Madam, Could you please inform me of [1a] the total number
of homophobic hate crimes reported to you in the last year [b] the last
three years [2a] the total number of those hate crimes that were
reported to the Crown Prosecution Service in the last year [b] the last
three years.
Section 1 of the Freedom of Information Act 2000 (FOIA) places two
duties on public authorities. Unless exemptions apply, the first duty
at, Section 1(1) (a), is to confirm or deny whether the information
specified in a request is held. The second duty at, Section1 (1) (b), is
to disclose information that has been confirmed as being held.
Under the provisions of those sections of FOIA, I can confirm that
information you requested is partially held by Gwent Police. Therefore
we are able to partially comply with your request to supply data.
Q1. The total number of homophobic hate crimes reported to you in the

A1. I have attached the details of this question in the attachment to

I am writing to request an internal review of Gwent Police's
handling of my FOI request 'Homophobic hate crimes reported to
police'.
A full history of my FOI request and all correspondence is

Gwent Police did not fully respond to my request and did not supply
information requested about the number of hate crimes that were
reported to the CPS by Gwent Police within the timeframe specified.
This information has been easily sent to me by other police forces.

Freedom of Information Request 2008 / 6966
Thank you for your email dated the 7th November 2008 asking for your recent disclosure to be reviewed as you believe that Gwent Police did not supply information requested about the number of hate crimes that was reported to the CPS within the time frame specified.
I have reviewed the information we hold and revisited the audit trail on this particular case. Your original request asked for the following:
1 a) the total number of homophobic hate crimes reported to you in the last year
1 b ) the last three years
2 a) the total number of those hate crimes that were reported to the Crown Prosecution Service in the last year
2 b) the last three years.
Section 1 of the Freedom of Information Act 2000 (FOIA) places two duties on public authorities. Unless exemptions apply, the first duty at, Section 1(1) (a), is to confirm or deny whether the information specified in a request is held. The second duty at, Section (1) (b), is to disclose information that has been confirmed as being held.
In relation to question 1 (a) and (b) we provided to you a table of recorded crimes that only satisfied your request up to financial Year 2007 to 2008 for periods up to and including June. This as you clearly indicated did not comply with your original request for the total numbers of homophobic hates crimes reported in the last year.
Please accept my sincere apologies for this error and find enclosed the correct figures as per your original request on the 7th November 2008. I have also supplied this current financial years figures for your information.
To assist you further you were given a link to our Force Policy in relation to Hate Crime. After checking this link it was found that this was in fact incorrect. Therefore I have now provided the correct link for your information.

In relation to your question 2 (a) and (b), the response remains the same as this engages exemption 21, information accessible to applicant by other means.
