Dear Home Office,

I am seeking a copy of any document that illustrates or refers to
guidance that was contained in Annex C to Home Office Circular
46/2004.

Specifically, the part of the guidance that I am researching is:

‘Once a former officer receiving an injury pension reaches the age
of 65 they will have reached their State Pension Age irrespective
of whether they are male or female. The force then has the
discretion, in the absence of a cogent reason otherwise, to advise
the SMP to place the former officer in the lowest band of Degree of
Disablement. At such a point the former officer would normally no
longer be expected to be earning a salary in the employment
market.’

I would be interested in having copies of any document that was
instrumental in informing this part of the guidance. For example,
any court judgements, reports, memoranda, meeting minutes,
enquiries, surveys, correspondence, etc. I cannot be more precise
as I am not privy to what documents may be available, so will rely
on the requirement of Section 16 (1) of the Freedom of Information
Act that you should assist the enquirer, which I trust you will do
by firstly advising me what documents are available and then
allowing me to select which documents I require.

The Home Office will be aware that there is no mention in the
relevant Police Pensions Regulations for the band of degree of
disablement to be adjusted by reference to the supposed salary
earning potential of a former officer at age 65. The aim of my
enquiry is therefore to understand how the approach of using age
and an assumption of cessation of employment opportunity found its
way into the guidance. I cannot imagine that a departure of such
significance from past practices and understanding could have been
arrived at by any casual means and I believe that there will be
records of the reasoning process that must have been conducted
before the guidance was written and issued.

I write in regards to your email of the 15^th May 2009 and your request
for an Internal Review into the handling of your Freedom of Information
Act request concerning Home Office Circular 46/2004.

I have just started to review the handling of this request and our records
show that a substantive response to your request was sent on the 14^th
April 2009. This response was also resent on the 6^th May 2009 in response
to your reminder email of the 30^th April 2009. I have noticed that the
