Dear Sir or Madam,
With regard to the Freedom of Information Act 2000, I request the
following information:
1 Please advise if monies were spent on legal fees challenging the
King George V Playing Field status of Heath park, Cardiff or of
areas of Heath Park. If so, please advise: 1a How much money was
spent. 1b From which area of council budget these monies originated
1c Which Council member sanctioned the expenditure of this money 1d
On what basis the decision was made to challenge the status of this
area of Heath Park, Cardiff.
2 Please advise why the Council made the decision to “dispose” of
areas of Heath Park, Cardiff in favour of the Heath Model
Engineering Society 3 Please advise whether Cardiff Council has
received any monies from the Cardiff Model Engineering Society or
if money is expected to change hands with regard to this disposal.
4 Please advise if the Council is considering disposing of any
further areas of Heath Park to any individuals, private companies,
societies or other bodies 5 Please advise to whether the Council
has conducted an environmental survey on the area due for disposal
and whether they are aware that this area includes the habitat of
protected species (great crested newt, bats) 6 Please advise as to
whether the Council has contacted the Countryside Council for Wales
regarding this disposal 7 Please advise whether this disposal
contravenes the Councils’ “Parks and Open Spaces Strategy”.

Thank you for your request under the Freedom of Information Act 2000 about issues relating to Heath Park received on 18th September 2008. The request has been sent to Parks Services.
We are considering your request under the terms of the Freedom of Information Act, you should receive the information requested within the statutory timescale of 20 working days, unless the information is exempt or we require additional time to consider whether disclosure is in the public interest in accordance with section 10(3) of the Act.
Cardiff Council's policy is to carry out the spirit and requirements of the Freedom of Information Act in a manner which:
- recognizes the duty to inform as the essential principle underlying the legislation;
- discloses to requesters the maximum information possible which is not injurious to the public and private interests identified in the exemptions in the Act and does so in the most timely and consistent manner given the nature and scope of the request;
- ensures that fees permitted under the Act are kept to an absolute minimum whilst safeguarding our position as a non-profit making repayment department

Dear Mr Britton
Thank you for your Freedom of Information Request, submitted on the 19th
August. I regret that I only received your return e-mail address on the
25th September.
I will respond to your questions in the order they have been raised.
1 (a - c) No legal fees have been incurred by the council to date.
1(d) The Council did not intentionally set out to "challenge" the
status of the area. The simple fact is that the Opinion of Counsel, as
appointed by the Charity Commission, indicated that the proper procedure
had not been adhered to in designating the land a King George Field and
therefore the designation was void.
2 The Council has not yet made any such decision. The only decision the
Council has made is to advertise the proposed disposal of the land. In
due course, the Council will consider the representations it has
received and the various factors pertaining to the issue, and make a
decision.
3 No money has been received from the Society. If the disposal were to
proceed, the existing lease would be revised and the rental for the site
subject to a review.
4 No.
5 The a ecological value of the area is known. Planning permission
requires the newts to be re-located and CCW have prepared a licence for
this but it currently held in abeyance.
6 Yes , several times.
7 No , we believe it does not.
