This investigation report is ready for publication and relates to patient safety at West London Mental Health Trust ....and the wider area! Earl Howe (Lord Darzi's opposite in Parliament ) has committed to writing to CQC in the light of Lord Darzi's answer to written questions which Lord Howe feels are insufficient.
There is also an investigation report into a fatal incident at Broadmoor Report outstanding and as WLMHT are in charge of management of Broadmoor too then the faster we can access these documents the more we can affect patient safety.

Dear Sir or Madam,

Please pass this on to the person who conducts Freedom of
Information reviews.
I am writing to request an internal review of Care Quality
Commission's handling of my FOI request 'HC Investigation Report
into WLMHT'as i remain concerned that your response is not within
FOI guidance.

Please review your comments on the reason why exemption is being
sought under Section 22.

As stated on my request into remit of the MHAC, you have also
responded to my request for access to a copy of the HC
Investigation Report into WLMHT in particular. Thank you for your
information on how many investigations CQC inherited from HC.

Specifically, you are claiming exemption from discloure under
section 22 of the FOI Act 2000 and if your are using that I believe
you should also be providing me with a list of points for and
against disclosure and reasons as to how an overall balance was
reached in your decision?

The FOI guidelines state: "Information that is of "Public
Interest", means that it is in the something which serves the
interests of the public, not something that might be interesting!

I believe as a public authority you have to decide whether in this
case, your decision serves the interests of the public better to
withhold or to disclose information. I do not believe your comment
on public interest has been interpretated as per specific FOI
guideance in the reference to Public Interest Test and I am asking
for more details on how you reached your decision and also a full
timetable for release to determine whether your decision can be
considered reasonable or not.

publication date for the HC Investigation Report into Patient
safety at WLMHT. The report will be placed on CQC website on the

Many thanks for your prompt response and my apologies, I have made
an error in that the 21st July is Tuesday not Monday.
So to confirm:
The WLMHT Report will be published "shortly after midnight on 21
July 2009." That's the midnight going into 21st I assume aka
Tuesday early morning....am I correct?

Please also advise: How long will the Report remain online?

Dear Lok, Kim,

Can I thank you for your time and confirm I now have a copy of the
Report, prior to publication tonight, from the CQC Investigation
manager Margaret McGlynn.

With regard to your recent response, thank you for confirming the
length of time Reports generally remain online and that it is
'likely to be the position that the HC Investigation into West
London Mental Health Trust will as well'

If I was being pedantic I would seek more clarity on the word
'likely' but I shall accept this response with good grace and trust
the investigation report will be freely available for the public to
access for the foreseeable future.
