Dear Sir or Madam,
Re Elmbridge Borough Council Planning Application 2008/1600
Concerning development on Zone 3 flood plain.
Kindly inform me whether the EA accepts the developer's reason, of
the proposed train station refurbishment driving the development,
as justifying their application of the statutory flood plain
Exception test and the omission of the statutory flood plain
Sequential Test, now that the station is already being refurbished.

If the EA accepts the omission of the Sequential test, kindly
explain the reasons.

Dear Mr Palmer
I have just been forwarded the attached email you sent to Unit Enquiries
on the 19 February 2009 requesting to be sent a response to your Freedom
of Information request, originally received by email on the 25 January
2009, as you state that we are late in responding.
I understand from our records that my colleague Andy Goymer emailed you on
the 27 January 2009 acknowledging receipt of the attached Freedom of
Information request, and an additional 2 requests. As per Andy's email we
have 20 working days to respond to Freedom of Information request from the
date or receipt. As we received your Freedom of Information request on the
25 January our date for a response would be the 23 February 2009.
According to our records Andy did respond to your Freedom of Information
request by email on the 10 February 2009. Andy also stated in his email
that if you had any further questions you could contact him directly by
telephone or email quoting the above reference number.
