Gary Crow made this Freedom of Information request to Environment Agency
Response to this request is long overdue. By law, under all circumstances, Environment Agency should have responded by now (details). You can complain by requesting an internal review.
From: Gary Crow
31 January 2009
Dear Sir or Madam, Please inform me whether the Agency recommends
or requires a sequential test to be run for this site, as the
station refurbishment, which was driving the development, has new
been completed and there is no need for the development to be built
on the station site, a zone 3 flood risk site (the highest
category).
Yours faithfully,
Gary Crow

Dear Mr Crow
Re: Sequential Test - Hampton Court Station / Jolly Boatman site
The Environment Agency can only assess a planning application on the
information submitted by the developer. Our role is to provide general
guidance on the sequential test process and to provide technical flood
risk comments to Elmbridge Council. The local authority is responsible for
the application of the Sequential Test.
The Environment Agency only has a limited role in assessing the
methodology or evidence base for the sequential test (either borough-wide
or at planning application stage) as this pertains to the wider planning
application decision making process. It is the council's role to apply
both the sequential and exception tests and to make the final judgement
and determination on whether or not the development meets the requirements
of PPS25.
Please find attached a letter written to Elmbridge Borough Council dated
27 August 2008 (Ref: SL/2008/103567/01-L01). This letter contains the
requested conditions to our key issues.
If you have any further questions please email me at the address below

as of the date of this letter. We accept no liability whatsoever for any
