Gross Conflict of Interest CAFCASS Guardian & Judges

P.Adams (Account suspended) made this Freedom of Information request to Children and Family Court Advisory Support Service

The request is waiting for clarification. If you are P.Adams (Account suspended), please sign in to send a follow up message.

From: P.Adams (Account suspended)

27 October 2009

Dear Sir or Madam,

Please declare the fiduciary interests of appointed officers &
judges that ensures honesty and fair play in the best interests of
the 'child'

State how many cafcass officers & judges have committed acts of
gross mis-conduct by not declaring a conflict of interest.i.e.
having worked formerly for and/or in a local authority and
pretending to act independently whilst the same authority is
removing children from families.

Many local authorities are breaking mandatory procedures whilst the
same guardians & judges turn a blind eye.

Unfortunately the system as it stands is completely un-just and is
more crooked than a dog's hind-leg.

Please do not avoid answering, as it is clearly in the people's
best interest in-order to demand the changes needed.

regards,

P.Adams

Dear P.Adams

I have considered your request for information and I am not satisfied with the details you have provided me.

Under Section 8(1) of the Freedom of Information Act 2000, an applicant must provide their real name for a request to be valid and fall under the scope of the Act.

I suspect that the name you use ‘Mr Piper’ is not your real name and that you are in fact utilising the names of various people some involved in children's social work.

Cafcass will therefore not proceed to consider the above requests, or any further requests for information by you, or deal with any requests for review until you are able to provide me with authentic identification which verifies who you are, for example an original utility bill showing your full name and postal address.

On receipt of such evidence, I will progress your requests and will of course be happy to return any documentation to you without keeping a copy on file.
If your name really is as stated I apologise in advance for any inconvenience that providing proof of identity may cause you.

If you are unhappy with this decision, and object to providing proof that you are using your real name, you can appeal to the Information Commissioner, who oversees compliance with the Freedom of Information Act 2000. Details of what you need to do, should you wish to pursue this course of action, are available from the Information Commissioner's website http://www.ico.gov.uk/

Chris left an annotation (16 December 2009)

"8. Request for information
(1) In this Act any reference to a “request for information” is a reference to such a request which—
(a) is in writing,
(b) states the name of the applicant and an address for correspondence, and
(c) describes the information requested. "

"Name" is not defined in law, and it's well established that people are entitled to call themselves anything they like (within reason). The ICO has also said in the past that since requests should be applicant-agnostic it frowns on authorities rejecting requests because the requester has used a pseudonym or not provided their full name.
