Dear Sir or Madam,

Recently in the House of Commons Harriet Harman spoke of
introducing legislation to allow discrimination based on race and
gender.

She presented this under the guise of 'positive discrimination' to
allow employers to give preference to women and/or ethnic minority
candidates.

I would like details of the official legal test for an individuals
ethnic status and their gender.

So, for instance, if someone is discriminated against (or for) on
the basis of their ethnicity or gender what legal test would be
available to prove that they were indeed of the claimed
ethnicity/gender and to prove that the other candidates were not.

I am sure that no legislation would be proposed if these basic
issues were not already clearly addressed, so I look forward to a
rapid response.
