Dear Sir/Madam
Perhaps you can assist?
I have been trying to obtain information from authorities in
Gibraltar and I copy below the text of an email to you (FCO) on the
6th inst which I trust explains this contact
--
Hello,
I would like to make a FoI request and/or a SAR (DPA) request to
authorities in Gibraltar. I have made enquiries before without
success and a year or so ago was referred by you to a dept in
Gibraltar (I can't remember which) but I got a reply from a Mr
Ramagge. I sent Mr Ramagge the following email a week or more ago
but have not received a reply :
Dear Mr Ramagge,
On behalf of the Chief Secretary you replied to a letter I sent on
the 30th September 2008 (regarding a request I made for personal
data) saying you had forwarded the request to The Governors Office,
the A-G's Chambers and the Royal Gibraltar Force.
I have not received any response from any of the three departments.
Is it a matter which you could help with?
Regards, David Schiller
The three departments (The Governors Office, the A-G's Chambers and
the Royal Gibraltar Force) are the ones that would hold the
information I seek : Could you tell me exactly which dept or
authority I should send any FoI or SAR request to
---
Can you please supply the contact details of the authorities
mentioned?

Sincerely
david schiller

Dear Sir or Madam,
' Please refer to the above appeal with regard to which the office
of the Supreme Court registry has much correspondence,
documentation and other information
It would be appreciated if you would supply the writer with all
information relating to the Appeal that the FOI Act requires you to

Dear Sir
Thank you for your email, copied below. This is not being treated under
the FOI Act by the Foreign & Commonwealth Office as you are asking us to
forward to a third party. I have however, forwarded this to our public
correspondence Unit to be logged and allocated to the appropriate
department for reply. They will be in touch with you with their response.
Yours Sincerely

Again-thank you, but....
When I click on the [emailaddress] I get an FCO website and back on
the round-about ride I've had several times. I've tried the email
form for queries but am unable to use that for some reason
connected with my computer (either the physical one in front of me
or the probably missing one in my head)
I've also spoken on the telephone to several people at the FCO. An
alternative, I suppose, is to make a FoI request to, for example,
the Registry of the Gibraltar Supreme Court through your office?
Sorry to be a pain

Dear Mr Schiller,
I am writing in response to your letter of 15 October 2009 regarding
Freedom of Information requests, data protection enquiries and contact
details for various authorities in Gibraltar. It is not entirely clear
from your letter exactly what you are asking for, however the following
information may help resolve the issue.
Gibraltar is not subject to FOI and is therefore not required to disclose
any information. The UK Data Protection Act 1998 does not apply to
Gibraltar. Gibraltar may be subject to its own information/data
protection rules; I would suggest you contact the Government of Gibraltar
for information in relation to Gibraltar laws. Any further requests for
information should be communicated directly with the appropriate authority
in Gibraltar and not through the FCO.
Contact details for the Gibraltar authorities mentioned can be found on
the World Wide Web, however for ease I direct you to the following
websites:

Dear Alison
Thank you for the response
The three specific authorities for which I wanted some Information
are, as you know,The Governors Office, the A-G's Chambers and the
Royal Gibraltar Force
Is it considered that none of the three would properly come under
the category of a UK 'government department' (ie the FCO)
Is the FCO responsible for the actions of the three departments
(and the Gibraltar government) without control of their actions?
Yours faithfully,
david schiller

Dear Alison,
Thank you for your help.
Although you give the contact details for the office of the
Governor and the Police/AG I can't seem to get an appropriate email
address from either site regarding the issue in dispute.
Could you give me an email address for the Governor and one for the
AG and police that is appropriate to the issue of whether or not
they are 'UK ''government departments' or not
It would also be helpful if the FCO would confirm that none of the
three departments referred to in my request are UK 'government
departments'

Dear Mr Schiller,
I am writing in reply to your letter of 21 October 2009 in which
you requested that an information request letter be forwarded to the
Supreme Court Registrar in Gibraltar.
As I also indicated in my letter to you of 1 Dec 2009, any further
requests for information should be communicated directly with the
appropriate authority in Gibraltar and not through the FCO.
I would like to remind you that, as also outlined in the same
letter, Gibraltar is not subject to FOI and is therefore not required to
disclose any information. The UK Data Protection Act 1998 does not apply
to Gibraltar. Gibraltar may be subject to its own information/data
protection rules. As such I again suggest that you contact the Government
of Gibraltar for information in relation to Gibraltar laws.
Sincerely
Alison Cross

Hello again Alison,
I don't really understand your email but clearly we're going over
old ground
Unless the FCO are prepared to take the issues involved as serious
and reply substantively to my email of the 8th Dec I would request
an internal review
If you do intend to reply to my last post please ignore the
'internal review' pending consideration of what the FCO say and any
necessary response
Please note that, as in the Privy Council Case, I am a party to the
legal proceedings in Gibraltar and am entitled to disclosure of
information held by the Supreme court registry and other relevant
authorities (eg RGB/AG) under both the Freedom of Information Act
(refer to previous posts, so far unanswered) and the Gibraltar
Constitution Order
I am also, as a British Citizen, entitled to expect the government
authorities to take action to protect my Human Rights under the
terms of the Human Rights Convention and end their support for
those who have committed serious criminal acts in both Gibraltar
and the UK without regard to their status

Dear Mr Schiller,
The FCO cannot conduct an internal review as your request was not dealt with under the provisions of the Freedom of Information Act.
You may wish to contact the officer or department that dealt with your original request directly.
Sorry I cannot assist further on this occasion.
Yours,

Dear Foreign and Commonwealth Office,
Hello again Mark
Having dealt with Alison Cross I asked for an internal review but
because it is not being considered as a FOI request such procedure
is said not to apply but it was suggested I might try contacting
you again
If the FCO still consider they are not involved I will accept it
(for now at least) but I would like a FCO response to my email to
Alson Cross if possible, viz:
The three specific authorities for which I wanted some Information
are, as you know,The Governors Office, the A-G's Chambers and the
Royal Gibraltar Force
Is it considered that none of the three would properly come under
the category of a UK 'government department' (ie the FCO)
