Dear Sir or Madam,

My previous FOI request (DJAN - 7SPDES) revealed Merseyside Police
flew the rainbow flag from a number of its police stations for one
week from 14/05/2009 to 20/05/2009 without prior planning
permission being granted and without any action being taken against
Merseyside Police or any individuals.

Before I consider a private prosecution against Merseyside Police,
please inform me:-

1. How many prosecutions have been made via Merseyside Police in
the five years previous to the rainbow flag being flown on
Merseyside Police stations, 14/05/2009 to 20/05/2009, against any
company or individual for flying any flag from any building?

2. And/or in the same five year period how many times any company
or individual has been instructed by Merseyside Police to take down
any flag being flown from any building?

3. For the cases in 1 & 2, what, if any, the offending flags were?

I wish it to be known that I have no problem with flags being flown
from public buildings provided the required planning permission has
previously been granted and paid for.

What I do object to is people being harrassed for flying national
flags perfectly legally from their dwellings or places of work, for
which planning permission is not required, and being ordered to
take them down.

Dear Sir or Madam,

My FOI request clarification is overdue a response. As I am
considering a private prosecution it is imperative I receive a
prompt reply in order for me to comply with the time constraints
between an alleged offence being committed and the prosecution
being served.

If I do not receive a satisfactory reply I will be compelled
request an internal review or register a complaint to the
Information Commissioner.

I write in connection with your request for information received on

concerning:

(paraphrased) application relating to non-national flags and
prosecutions.

The cost of providing you with the information is above the amount to which
we are
legally required to respond i.e. the cost of locating and retrieving the
information
exceeds the ‘appropriate level’ as stated in the Freedom of Information
(Fees and
Appropriate Limit) Regulations 2004. It is estimated that it would take in
excess of 18
hours work, which equates to the cost limit of £ 450:00p to comply with
your request.
