Dear Sir or Madam,

"In a report on the Future of Tobacco Control consultation
published on Tuesday 9th December 2008, the Department of Health
appears to have deliberately omitted evidence offered by the
Tobacco Retailers Alliance.

Ken Patel, Leicester retailer and National Spokesman for the
Tobacco Retailers Alliance, said: "First the Minister refused to
meet with retailers, now they have censored our formal response to
a public consultation.""

Dear Mr Walker,

Thank you for your email of 5 January requesting, under the Freedom of
Information Act, information about the Consultation on the future of
tobacco control. Your email has been passed to me for reply.
As you are aware, a report on the Consultation on the future of tobacco
control was published on 9 December. The annex to the report included a
list of organisations that had made formal responses. Following requests
from a number of organisations who were not listed in this version, the
annex of respondents in the consultation report published has been
expanded accordingly. This is now available on the Department's website
at: [1]www.dh.gov.uk/en/Consultations/Responsestoconsultations/DH_091382.
The Department welcomed and considered all responses from organisations
and individuals received during the consultation period. Where an
individual who is a key figure in an organisation has submitted a response
it has not always been clear if the response should be considered as an
individual response or one representing the view of their organisation.
It was always intended that the report should be a summary analysis of
responses rather than a comprehensive list of every point raised by each
of the almost 100,000 respondents. Responses to the consultation will
also help to support the development of the new tobacco control strategy
to be published later this year.
The report commissioned by the Tobacco Retailers Alliance from the Centre
for Economic and Business Research has been considered in depth within the
Regulatory Impact Assessment accompanying the Health Bill.
During the consultation process, the Minister and her officials met with
representatives of retailers, including the Association of Convenience
Stores, who represent 33,000 small retailers, and the British Retail
Consortium.
