I am writing with regards to your e-mail, received 17 October 2009.
The Council responded to both parts of the consultation on elective home
education, i.e. the original questionnaire and the follow-up request for
additional information.
As stated in our FOI response we are unable to provide a copy of our
response to the original questionnaire as we do not currently hold a
copy (we are, however, requesting a copy from the DCSF and would be
happy to provide a copy when we receive it). We do hold a copy of our
response to the request for additional information and a copy of this
was sent in response to your FOI request.
We are not aware of any other documentation being requested by the DCSF
or sent by this authority in respect of the Badman Review; if you
believe there to be additional information held by the Council, I would
appreciate it if you could clearly describe it by return.

Dear Sir/Madam
Thank you for your e-mail dated 11 November 2009, in which you request
an internal review of your request for information.
From your initial enquiry, dated 7 October 2009, we understood that you
required a copy of Darlington Borough Council's response to the request
from the DCSF for additional information for the review of Elective Home
Education. A response was provided to this request on 15 October (i.e.
within the 20 working day timescale).
Following a series of correspondence with you, we became aware that you
did not require this information and that you actually required
statistical information that was requested by the DCSF. This only
became clear to us on 20 October 2009, therefore giving a revised
deadline of 17 November 2009. We accept that we have not yet provided a
response but we do not accept that we have exceeded the 20 working day
timescale.
I am now in a position to provide a response to your request:
I can inform you that Darlington Borough Council does not currently hold
the information that you have requested. The information was submitted
without a copy being retained by us. As a matter of courtesy we have
requested a copy of our responses from the DCSF, however, we are unable
to dictate a timescale for sending us this information. When we receive
this information from the DCSF we will be happy to provide you with a
copy. Alternatively, you may wish to approach the DCSF directly for a
copy of this information.
I hope this adequately addresses the points raised in your e-mail.

Dear Freedom of Information,
Given that your reply states "We requested a copy of our response
from the DCSF some months ago", I suggest that this is not the
statistical response I am requesting. I am asking for information,
requested by the DCSF/Mr Badman on 17 Sept 2009, which had to be
returned by 1 October 2009. That is not "several months ago."
In addition, further information has come to my attention since
your reply.
In a recent Parliamentary question about Mr Badman's further call
for evidence, the DCFS provided a table which lists Local Authority
responses to one of the questions asked in this data request of 17
September 2009:

You will note that Darlington is listed with 97 EHE children, not
the 87 stated in the response you returned to me. This supports the
DCSF's inclusion of the Authority in it list of 74 respondents:

matter of urgency.

Thank you for your e-mail.
It appears that there may have been some confusion in the client
department with regards to the information you have been requesting.
They have reconsidered your request and provided me with the attached
spreadsheet. Could you please confirm whether this is the information
that you require?
With regards to the difference in the number of electively home educated
children I am advised that 97 were recorded at the time when we
responded to the review; however, this number constantly fluctuates.
I sincerely apologise for this protracted correspondence. At the time
of your previous request and subsequent appeals I was assured that we
did not hold this information. I assure you that I will be raising this
issue with the client department.
