Could you please provide the following information:

The level of capital and recurrant funding provided by Peterborough City
Council to Vivacity for the provision of Leisure, cultural and other
activities on behalf of Peterborough City Council. Please provide a
breakdown for the years:

2006\2007

2008\2009

2009\2010

Furthermore, what requirements are there in existing and proposed
procurement strategy to subject companies and organisation established to
deliver public services to the Freedom of Information Act.

Your request for information has now been considered and the information
requested is given below.

Could you please provide the following information:

The level of capital and recurrant funding provided by Peterborough City
Council to Vivacity for the provision of Leisure, cultural and other
activities on behalf of Peterborough City Council. Please provide a
breakdown for the years:

2006\2007

2008\2009

2009\2010

Vivacity was created on 1^st May 2010. There was therefore no funding for
these years.

The Cabinet report (from the Cabinet meeting of 22^nd March 2010) on the
creation of Vivacity is available on Peterborough City Council's web site

Furthermore, what requirements are there in existing and proposed
procurement strategy to subject companies and organisation established to
deliver public services to the Freedom of Information Act.

Reference to the Freedom of Information Act is covered under Peterborough
City Council's standard terms and conditions which form part of the
Council's tender documentation.

The following is an extract from the Council's standard tender
documentation, it should be noted that the Conditions of Contract section
will form part of the terms of any Council contract:

Instructions to Bidders section

The Council undertakes to use its best endeavours to keep confidential any
information provided by the Bidder, subject to the Council's obligations
under law, including the Freedom of Information Act 2000. If the Bidder
considers that any information communicated to the Council should not be
disclosed because of its sensitivity then this should be stated, together
with the reason for considering it sensitive. The Council will then use
reasonable endeavours to consult with the Bidder in considering any
request received under the Freedom of Information Act 2000 before replying
to such a request. It should be noted however, that the Council does not
have discretion in responding to such requests under the FOI Act 2000.

Conditions of Contract section

1. Freedom of Information

1.1. Notwithstanding anything to the contrary contained or implied in
any documents, negotiations leading to the formation of this agreement
or in this agreement:

1.1.1. the Council shall be entitled to publish and/or release
any and all terms or conditions of this agreement, the contents of
any documents and/or information relating to the formation of this
agreement under the provisions of The Freedom of Information Act
2000 as it sees fit;

1.1.2. nothing contained in this agreement shall prevent the
Council from disclosing and/or publishing under The Freedom of
Information Act 2000 any term or condition or information
contained in or relating to the formation of this agreement.

1.2. The Contractor shall:

1.2.1. co-operate with the Council and supply to it all necessary
information and documentation required in connection with any
request received by the Council under The Freedom of Information
Act 2000;

1.2.2. supply all such information and documentation at no cost
to the Council and within seven days of receipt of any such
request.

1.3. The Contractor shall not publish or otherwise disclose any
information contained in this Agreement or in any negotiations leading
to it without the Council's previous written consent.

The information supplied to you in response to your request is the
copyright of Peterborough City Council and is protected by the Copyright,
Designs and Patents Act 1988. You may use it for the purposes permitted by
that Act, including non-commercial research and news reporting. Any other
re-use, for example commercial publication, requires the permission of the
copyright holder. If you wish to re-use any information supplied you must
first gain the Council's explicit written consent. In order to make a
