Mr Watts

12 October 2008

Dear Sir or Madam,

Will the nationalised UK banks, in particular those which the
Labour Government now has a controlling stake in, be covered by the
Freedom of Information Act?

Will salaries - benefits - bonus payments be a matter of public
record?

Yours faithfully,

Mr Watts

Prime Minister's Office

13 October 2008

Dear Mr Watts,

Thank you for your email dated 12 October 2008. In the first instance, I
would advise you to contact HM Treasury as they are more likely to hold
the information you have requested. I have provided their contact
details below:

Postal Address:
Correspondence & Enquiry Unit, Freedom of Information Section, 2/W1, HM
Treasury, 1 Horse Guards Road, London, SW1A 2HQ

Fax no: 020 7270 4861

Email: [email address]

I would suggest that you reword you request before you send it to HM
Treasury as the Freedom of Information Act provides access to recorded
information rather than necessarily answering questions. The guidance
issued by the Information Commissioner's Office at the following link
may be of help to you in writing a request.
http://www.ico.gov.uk/upload/documents/l...
actical_application/its_public_information_foi%20charter_final.pdf

If you still would like the Cabinet Office to run a search do get back
in touch but we believe that HM Treasury is more likely the information
you have asked for.

I hope this is of assistance to you.

Kind Regards,

FOI Team
Cabinet Office

It depends on how they are nationalized.

For example, there was a vote in Parliament to dis-apply the Freedom of Information Act to banks nationalized under the Banking (Special Provisions) Act -- which was used to nationalize Northern Rock.

If, on the day, 50 MPs had chosen to vote the other way, then all business relating to Northern Rock would be subject to FOI; it's as simple as that.

Find out which way your MP voted and either commend them, or ask them to explain why they decided the way they did.
