Dear Sir or Madam,
I demand an internal review of the way the Council has been
handling this FOI request.
When are you going to respond? A response is now well overdue. The
Council is in breach of Freedom of Information Act 2000. Is your
long silence because you are trying to hide some information to the
public?
Please respond ASAP, otherwise I will have no hesitation to report
the matter to the Information Commissioners. Your delay in
responding is unacceptable under the Freedom of Information Act
2000.
Yours faithfully,
Mr Jones

Dear Mr Jones,
Thank you for your e-mail dated 3 July 2009, concerning the above FOI
request.
I can advise that a response to your request was initially sent to the
e-mail address indicated on 5 June 2009. The response address contained
within the original request was- [email address]. I
have enclosed a further copy of the response for your information. I have
also requested a delivery receipt on this latest response so that it is
acknowledged, from our end, that this correspondence and attachment have
been delivered to the electronic address that you have indicated.
I can assure you that having completed the request myself that an effort
was made to provide a response to your request within the appropriate
timeframe. The response itself was sent from an alternative mailbox,
which has been implemented to solely respond to requests in relation to
motorcycle parking.
Due to the fact that failures can occur with the delivery of electronic
mail, we have implemented a process where an acknowledgement receipt is to
be requested in relation to all responses that are sent from this
mailbox. Regrettably, as I do not personally have access to this mailbox,
I am unable at this time, to ascertain whether an acknowledgment receipt
was in fact delivered, confirming that your request had arrived at the
intended designation. I can only conclude, in view of your e-mail that a
failure has occurred in delivery of the response.
I will therefore update this process to ensure that that paper copies of
these delivery receipts are also kept on record along with the FOI
request.
I apologise, that you have not yet received the response to your request.
Should you experience such difficulties in the future, please contact me
directly via the enclosed electronic address. I would also be more than
happy to provide any copy of a FOI request to you by post to further
ensure delivery.
Please find a copy of response to your FOI request enclosed. I further
apologise for any inconvenience caused.
Yours sincerely
Gordon Deas

Dear Customer Relations,
Thank you for your very late response. Please be reminded that the
Council is required by law to answer all FOI requests within 20
working days, any delays are unacceptable and against the law. In
future, I will have no hesitation to report any delays to the
Information Commissionner, under Freedom of Information Act 2000.
Since you have finally advised that no free motorcycle parking
permit is issued to any Council staff, whether councillors or
employees, please would you advise on what basis the Council owned
motorcycles referred to in the following website
http://nutsville.com/?p=730 were parked in the bay. In other words,
did the Council employees to whom each motorcycle was assigned pay
the daily parking tax of £1 or did they purchase an annual parking
permit for £100? If not, on what basis and permission were these
Council owned motorcycles parked?
Yours sincerely,
Mr Jones
