Dear Metropolitan Police Service (MPS),

A:- Please may I have ae copy of the following book,BOOK 105
covering 2008 for the BOCU of Greewich.

All officers attending domestic incidents complete a Book 124d as
per the Domestic Violence Standard Operating Procedures (DV SOPs).
Greenwich CSU is based in Woolwich and not at the main charging
station of Plumstead, therefore has adopted a local policy, whereby
all 124d’s are deposited with the IBO. In order to maintain an
audit, all 124d’s are entered into the book 105 in the IBO and
given a reference number. The IBO supervisor then countersigns the
book 105, confirming they have been handed the 124d. The compliance
of 124d recording currently standards at 94% and all non-compliance
is reported to Daily Management Meeting and actioned accordingly.

DECISION

I have today decided to:

* Apply the exemption provided under S40 Personal Information to data
that can identify individuals
* Fully disclose a summary of the details contained within the Book 105
which do not consist of personal data
* Provide you with a redacted example of the contents of Book 105.

REASONS FOR DECISION

Please see the legal annex for the sections of the Act that are referred
to in this letter.

Information that would identify or could assist in the identification of
individuals is exempt from disclosure by virtue of Section 40(2) of the
Act. In this instance the details contained within the Book 105 relate to
individual incidents of domestic violence. From the details contained
(which includes incident dates, unique reference numbers, initial officer
details etc) it would be possible for incidents to be identified and this
would lead to the identification of the individuals involved.

Furthermore as this data relates to criminal investigations it is also
considered sensitive personal data contained as defined by Section 2(g) &
(h) of the Data Protection Act. Sensitive personal data is afforded
further safeguards from disclosure.

In order for the exemption provided under Section 40(2) to be engaged
disclosure of the requested information must satisfy either the first or
second condition as defined by subsections 3 and 4.

Having reviewed the requested data I have decided that disclosure of this
information would breach principle one of the Data Protection Act, fair
and lawful processing. To determine whether or not the disclosure would
be fair and lawful I have considered the conditions for processing
personal data which are defined by Schedule 2 of the Data Protection Act.
There are two conditions that are relevant to this request. Condition 1
relates to the consent of the data subject and condition 6 relates to
legitimate interests. I do not believe that the data subjects (in this
instance the victims and suspects) would agree to public disclosure of
their personal information. In relation to condition 6, there is no
legitimate public interest in disclosure of the personal details. My
conclusion therefore is that disclosure would not be fair or lawful.

I have applied the exemption provided under Section 40(2) of the Freedom
of Information Act to this information as the first condition, defined in
subsection 3(a)(i) of Section 40 has been satisfied. A link to the Data
Protection Act is available in the legal annex.

Summary of non-exempt information:

As you are already aware from the information provided in the MPA website,
which you made reference to in your application, Greenwich BOCU use the
Book 105 to record and monitor the receipt of completed 124d forms. This
is a local procedure which has been put in place due to the fact that the
Greenwich Community Safety Unit (CSU) is based in Woolwich and the main
charging station is in Plumstead.

The book 105 is primarily used to monitor the transit of property. It has
columns such as prisoner's name, department number and property
description which have no relevance to this local policy and therefore
these columns have been used to record other information such as unique
reference numbers for various MPS systems, sequential log numbers for each
124d and CSU staff details.

The book itself is of an A4 size and each entry/row is spread across both
pages of the book making a single page of details A3 size. Each book
contains 200 of these A3 pages and the entries for 2008 span three books.
The three books provide a total of 600 A3 pages of data however they also
contain data relating to late 2007 and early 2009. Having reviewed the
books I can confirm that 403 A3 pages relate to forms 124d from 2008. I
can also confirm that there are 5045 entries for 2008.

I would like to draw your attention to Section 11 of the Act, the text for
which can be found in the legal annex. You have requested a copy of the
Book 105s that are used on Greenwich Borough to monitor 124d forms. As I
have documented above, this information is recorded over more that 400 A3
pages which predominately contain exempt information. In order to provide
you with a copy of these books significant work will be required to
photocopy, scan and redact the information to make it fit for disclosure.
Having considered the request and the information held I do not believe
that it is reasonably practicable to supply you with a copy of the
information.

To determine whether it would be reasonably practical to supply the
information in the requested format I have considered not only the
practicalities detailed above and the associated cost (which would be met
by the taxpayer) but also whether I perceive there to be any public
interest in providing the data. In this case I do not see any real or
tangible benefits to the public that would arise from disclosure.

In order to assist you have I attached a sample of contents from Book 105.
This has been redacted in order to remove exempt information.

Legal Annex

Section 17 of the Act provides:

(1) A public authority which, in relation to any request for
information, is to any extent relying on a claim that any provision in
part II relating to the duty to confirm or deny is relevant to the request
or on a claim that information is exempt information must, within the time
for complying with section 1(1), give the applicant a notice which-

(a) states the fact,
(b) specifies the exemption in question, and
(c) states (if that would not otherwise be apparent) why the exemption
applies.

Section 40(2)&(3) of the Act provides:

(2) Any information to which a request for information relates is
also exempt information if***
(a) it constitutes personal data which do not fall within subsection (1),
and
(b) either the first or the second condition below is satisfied.

(3) The first condition is***
(a) in a case where the information falls within any of paragraphs (a) to
(d) of the definition of ***data*** in section 1(1) of the [1998 c. 29.]
Data Protection Act 1998, that the disclosure of the information to a
member of the public otherwise than under this Act would contravene***
(i) any of the data protection principles or
(ii) section 10 of that Act (right to prevent processing likely to cause
damage or distress), and
(b) in any other case, that the disclosure of the information to a member
of the public otherwise than under this Act would contravene any of the
data protection principles if the exemptions in section 33A(1) of the
[1998 c. 29.] Data Protection Act 1998 (which relate to manual data held
by public authorities) were disregarded.

Section 11 of the Act provides:

(1) Where, on making his request for information, the applicant
expresses a preference for communication by any one or more of the
following means, namely***

(a) the provision to the applicant of a copy of the information in
permanent form or in another form acceptable to the applicant,
(b) the provision to the applicant of a reasonable opportunity to inspect
a record containing the information, and
(c) the provision to the applicant of a digest or summary of the
information in permanent form or in another form acceptable to the
applicant,
the public authority shall so far as reasonably practicable give effect to
that preference.

(2) In determining for the purposes of this section whether it is
reasonably practicable to communicate information by particular means, the
public authority may have regard to all the circumstances, including the
cost of doing so.

(3) Where the public authority determines that it is not
reasonably practicable to comply with any preference expressed by the
applicant in making his request, the authority shall notify the applicant
of the reasons for its determination.

(4) Subject to subsection (1), a public authority may comply with a
request by communicating information by any means which are reasonable in
the circumstances.

In complying with their statutory duty under sections 1 and 11 of the
Freedom of Information Act 2000 to release the enclosed information, the
Metropolitan Police Service will not breach the Copyright, Designs and
Patents Act 1988. However, the rights of the copyright owner of the
enclosed information will continue to be protected by law. Applications
for the copyright owner's written permission to reproduce any part of the
attached information should be addressed to MPS Directorate of Legal
