Dear Sir or Madam,
I would be grateful if you could confirm the existence or
non-existence of policy documents relating to the following issues
(these would include memos sent from the CPS to the police and/or
police generated documents):
- Suspects volunteering for interview at the police station;
- The use of bad character by interviewing officers in interview;
- Removal of males from domestic settings after a domestic
disturbance;
- Use of laptops and/or recording equipment including cameras by
defence representatives;
In the event that such documents exist please furnish me with
copies.

Dear Mr Hughes
Regarding the below in order for GMP to process your request, please can
you clarify the following.
What do you mean in regards to:-
1. The use of bad character by interviewing officers in interview ?
2. Use of laptops and/or recording equipment including cameras by defence
representatives ?
Please can you explain in more detail questions 1 and 2.
Please respond no later than 19th March 2009, failure to respond to the
above will result in questions 2 and 4 being withdrawn from your request.
Dear Mr Hughes
I write in connection with your request in regards questions 1 and 3 for
information which was received by Greater Manchester Police. These
questions will now be considered in accordance with the Freedom of
Information Act 2000 (the Act). You will receive a response within the
statutory timescale of 20 working days as defined by the Act, subject to
the information not being exempt or containing a reference to a third
party.
In some circumstances Greater Manchester Police may be unable to achieve
this deadline. If this is likely you will be informed and given a revised
time-scale at the earliest opportunity.
There may be a fee payable for the retrieval, collation and provision of
the information you request. If this is the case you will be informed and
the 20 working day timescale will be suspended until we receive payment
from you. If you choose not to make payment then your request will remain
unanswered.
Some requests may also require either full or partial transference to
another public authority in order to answer your query in the fullest
possible way. Again, you will be informed if this is the case.

Dear Caroline,
During interview, interviewing officers often refer to a suspect's
bad character, that being a record of their previous convictions
and/or dealings with the police. This should be adduced under the
Criminal Justice Act 2003 at court however, police now routinely
introduce this incorrectly to show evidence of propensity to commit
similar offences to the one being investigated, or just because
they want to show the suspect in a bad light. Because this happens
routinely, there must have been some consideration of the law for
police to adopt this as routine and therefore there must have been
some guidance issued to police officers in order for this to
happen.
Home Office Circular 24/1998 permits defence representatives to
record interviewing of suspects using their own recording
equipment. However, I have previously been refused the right to use
my laptop in making a record of the interview. Further, I have been
refused the right to use my camera in the custody suite. Presumably
this comes from Home Office guidance or police memos on the
subject. If not, then there is no right for the custody sergeant to
refuse me the right to use my laptop, camera or any other recording
equipment.

the following:
The original request did state that I wanted confirmation of the

information. However, the request went on to say that if such
documents did exist then I would be grateful for copies of them. It
is therefore a valid FOI request.
In respect of volunteers at the police station perhaps I could have
been more clear. I specifically wanted to know whether or not there
was a policy document which directed that the preferable way of
dealing with volunteers was to arrest them rather than to interview
them as volunteers or vice versa. Both situations would be governed
by PACE, of this I am aware.
I would be grateful for a copy of the Domestic Abuse Policy
Document if it is not widely available.
