Dear Sir or Madam,
I would like to make a freedom of information request for
electronic copies of all documents relating to the council's
ongoing dispute with Mr. Peter Moulder including, but not limited
to, Investigation reports, Planning reports, minutes of meetings,
etc.
As this information relates to the operation of the council's
Planning Committee Mr. Moulder's permission is not required but has
been obtained as a matter of courtesy. Naturally this can, and
should, be verified by contacting him at his usual place of
residence.

Dear Mr Graham
I am writing further to your request for information dated 13 October 2008 and to advise you that the information you requested is being withheld under the Freedom of Information Act 2000. You requested electronic copies of all documents relating to the council's ongoing dispute with Mr. Peter Moulder including, but not limited to, Investigation reports, Planning reports, minutes of meetings.
I can confirm that both the Planning and Legal Department hold information falling within the description specified in your request. However, we estimate that the cost of complying with your request would exceed the appropriate limit of £450. The appropriate limit has been specified in regulations and for local Government it is set at £450. This represents the estimated cost of one person spending 2½ working days in determining whether the Department holds the information, and locating, retrieving and extracting the information. Under section 12 of the Freedom of Information Act the Department is not obliged to comply with your request and we will not be processing your request further.
If you were to make a new request for a more narrow category of information, it may be that we could comply with that request within the appropriate limit, although I cannot guarantee that this will be the case. I must make you aware that there is also an exemption within the Freedom of Information Act, Section 30 that relates to Investigations. This is an exemption for information which is or has been held for the purpose of an investigtion or proceedings conducted by a public authority or which was obtained or recorded for the purpose of various investigative functions. If you submit a new request please bear this in mind as the Council will have to consider whether this exemption applies.
If you wish to object to the decision, in the first instance you may contact the Council's Professional Standards Officer in writing at the above address. Alternatively you could refer the matter to the Information Commissioner under section 50 of the Act for a decision as to whether the Council has dealt with your request in accordance with the requirements of Part 1 of the Freedom of Information Act.
