Dear Sir or Madam,
I would like to make a request under the FOIA 2000 for:
The numbers of administrative staff within the College between 1990
and 2005 (and broken down by year) that have:
1. been sacked
2. retired
3. made redundant
I would also like to request a copy of the accounts for any
hardship funds or bursaries administered by the College between
1992 and 2000. I understand that these may include names of
recipients. I am happy for you to redact these under section 40 of
the FOIA.

Dear Mr Kinnear,
Thank you for your request.
Under point 1. Records are only available from between December 2001 and
December 2005.
2004 - 2 made redundant.
2005 - 2 retired.
Under point 2. We only retain records for six years and so we are unable to
provide this documetation.

Dear Mr Charles,
Thank you for your response.
Could I request a copy of the policy that shows that you only keep
these records for 6 years? Please quote the source of this policy.
Section 16 of the Act requires you to advise and assist. I consider
that if you have some hardship fund records relevant to any part of
the period that I have referred to, then you have not acted within
the spirit of the Act and released these to me. Indeed, you have
not even revealed whether you hold anything. I would like to
request the relevant records for any period for which you hold
them. If you refuse this under Section 12 of the Act, then, in line
with ICO guidance, I expect a calculation as to how the cost limit
was reached, a list of files that you do hold and advise as to how
I can resubmit this request without breaching the limits in a
future request.
I would also like to request a list of documents that refer to
financial malpractice or any other kind of mistaken accounting in
the mid 90s when the hardship fund was running the College.

Dear Mr Kinnear,
I attach the College's Financial Regulations in which it is stated that we
retain financial related documents for six years - this appears on page 17.
In terms of accounts for any period relative to hardship funds, we lodge
such accounts (and many other forms of accounts) with the Charity
Commission. As such, we do not generally keep these on site but you may of
course request accounts from the Commission directly.
I would ask you to bear in mind that Heythrop College only became publicly
funded (and therefore required to adhere to FOI regulations) from September
2006. The College is committed to normalising it's internal administrative
affairs in accordance with best practice in the sector but inevitably, this
will take time to achieve in all areas and records/policies in place prior
to us becoming publicly funded, may well be less than those in place for
longer established publicly funded higher education establishments.
