I noticed on the Council website that the Mayor was to "attend the
commemoration of 70 years’ anniversary of the former Scunthorpe
Borough by Scunthorpe Charter Trustees"

What makes the Charter Trustees of the Town of Scunthorpe subject to FOIA? As far as I've been able to find out, only trustees established by the Local Government Act 1972 are covered by FOIA, and the Scunthorpe Trustees were established by the Charter Trustees Regulations 1996. I hope there's something I've missed, since it would be sensible if the newer trustees were also covered.

Ben, this is a very good question and I will do my best to answer but I am not a lawyer and may be completely wrong in which case the Council should respond by telling me I am wrong.

(1) According to the explanatory notes to the Charter Trustees Regulations 1996 "These Regulations make provision establishing charter trustees in consequence of orders made under section 17 of the Local Government Act 1992 ( “the Act") which give effect to structural changes recommended by the Local Government Commission for England in respect of local authorities."

(2) Section 17 of the Local Government Act 1992 states that:

"where charter trustees have been constituted under section 246 of the 1972 Act for an area which is altered by an order under this section and subsection (8) of that section (incorporation of whole or part of trustees’ area in parish) does not apply, the order may make such provision with respect to the charter trustees as appears to the Secretary of State to be appropriate."

(3) The Freedom of Information Act 2000 covers: "Any charter trustees constituted under section 246 of the M3 Local Government Act 1972."

(4) I **think** the upshot of all this is that the charter trustees will still be constituted under the 1972 Act even where there have been local government boundary changes/reorganisation and that the Charter Trustees of the Town of Scunthorpe are subject to FOI.

Hello Mr Cross. I refer to your request for information about the
Scunthorpe Charter Trustees.

North Lincolnshire Council has very little involvement with the Charter
Trustees other than allowing them to use a room at Pittwood House for
their annual meeting and any other meeting they may have which I
understand are fairly infrequent. I can however give you some background
to the establishment of the trustees.

Charter Trustees for the area of the former Borough of Scunthorpe were
established on 1 April 1996 following local government reorganisation in
this area. All North Lincolnshire Councillors who represent wards in the
former Scunthorpe Borough Council area are trustees. Other powers/duties
include -

1. The trustees must hold an annual meeting in each year.

2. The trustees may hold other meetings.

3. The trustees may appoint a town mayor and a deputy town mayor - they
have never done so.

4. The trustees may issue a precept of up to *30,000 - they have never
done so.

5. The civic regalia of Scunthorpe has been owned by the trustees since 1
April 1996. I also understand that the trustees may acquire or accept
gifts of historic or ceremonial property (other than land and buildings)
for the area for which they act.

The power of the trustees is largely ceremonial and there is no legal
power for them to act as consultees in relation to matters such as the
local plan, although there has been no objection to this and on occasions
the trustees have met to discuss issues of the this nature.

As mentioned previously North Lincolnshire Council provides accommodation
for meetings. The trustees have appointed their own Secretary and are
responsible for calling their own meetings. The current Secretary is
Councillor Darrell Barkworth who can be contacted at Pittwood House,
Scunthorpe on 01724 - 296348

In relation to your specific questions the Charter Trustees do not have a
publication scheme. The contact for the trustees is set out above. A copy
of the minutes of the most recent meeting are attached.

the Scunthorpe Borough charter trustees is a body that that prevents the residents in 7 wards within the unitary authority of North lincolnshire From having the first tier of local goverment (parish councils)
The Act that created these trustees is clear ,and published on the internet.

The Scunthorpe Borough Charter Trustees Act is clear. They are the custodian of the Borough assets until the formation of parish councils in the seven wards (Bottesford already has a town council and was never
part of the Scunthorpe Borough
I openly accused these charter Trustees of deliberately preventing the residents of the other ward from having the democracy of the first tier of local government for the last 14 years
There is something unpleasant and possibly racist going on, that in wards were most of the ethnic minority live there is no ward democracy as they do not have the first level of Local government.

It is party policy of Labour and the Consevative that there should be parish councils Hower this is not the case within NLC members
To an outsider such as me, it looks very much that the Abolished Scunthorpe Borough council is operating secretly inside North Lincolnshire council
