Please may I see any documents prepared for this court case
concerning the death of a pensioner regarding the budget deficit
which led to the smaller fine from the judge for health and safety
breaches by Stockport Council. Councillor Weldon, Executive
Councillor for Children and Young People's Directorate, told me
that the Council's barrister inadvertently misled the judge and
there was no budget deficit. Another report in the local paper said
the Council Solicitor - and I believe it was Barry Khan who
attended the court hearing - gave evidence regarding the budget
deficit. I am a bit confused as to whether the barrister and the
judge were correct in saying there was this multi-million pound
deficit which lead to the smaller fine, when Councillor Weldon has
subsequently informed me in an email that there was no black hole
in the Department's budget. My concern is that it was confirmed in
the full council meeting on 25th February the serious financial
problems the Children and Young People's Directorate is currently
having and I am wondering who is telling the truth. So, any
documents put before the court with regards to the budget deficit
(or not as the case may be) for the above mentioned court case
would be very much appreciated.

Stockport Council will respond to your request within 20 working days. If
there will be a charge for disbursements e.g. photocopying in order to

Dear Mrs Oliver,
I am writing in response to your request for information below (ref 2750).
Please see the attached documents. The level of fine was given due to the
fact that the Judge determined that there was no link between the
unfortunate accident and the Council's breach in health and safety
legislation.
The written statement was submitted to the Court and there was no
misunderstanding by the Judge. The statement shows that the Council will
need to find savings in the future to balance the budget. The Council is
currently making efficiencies savings to ensure that it has balanced the
budget.
