Failure of Council to post plans of sefton park schools expansion plans on Council website

Dear Sir or Madam,

Bristol City Council promised to upload the various proposals for
the expansion of Sefton Park Schools on their website.(8 or 9 pdf
files totalling about 8MB) They failed to do this until the day
before the Consultation period ended (claiming the files were too
big) essentially preventing the majority of stakeholders from even
seeing the plans. I would like to see all email or other
correspondance within the Council and between Council and the
independent Consultancy IRIS which concern the posting of these
plans. I would also like to see any correspondence received or sent
by the Council's IT department concerning the problems encountered
with the upload.

Dear Mr Williamson

In reply to your recent Freedom of Information request I can confirm
that the City Council and Consultants, IRIS, gave stakeholders access to
the plans through a number of public and stakeholder focussed meetings
held in September and October 2008.
The plans, notes of the meetings and Q & As were uploaded on 29th
October 2008.
Plans were originally forwarded to the City Council in a large, CAD
format. This was changed to a PDF format for uploading.
I have been advised that I am not required to supply copies of
correspondence referred to in your request.

This response should answer your request in full, however if you are
not satisfied with this response or wish to lodge an appeal against any
exemptions that may have been applied, you can do so by writing to the
Data Protection Officer at Bristol City Council Legal Services, The
Council House, College Green, Bristol, BS99 7PH, or [Bristol City Council request email].

If, after you have exhausted the council’s complaints procedure, you

Thank you for your e-mail of the 15th December 2008, a copy of which is below. I apologise for the delay in responding.

I note that you have requested confirmation of which exemption was applied. Within your original request, you asked for copies of correspondence rather than information itself. I can confirm that in accordance with the Freedom of Information Act 2000, a requester is entitled to be informed in writing by the Public Authority whether it holds information described in the request and if that is the case, to have that information communicated to them. In some cases, the Council will disclose copies of documents in response to a request, however the Act does not specify that copies of documents should be provided, rather that we provide the "information" requested, unless of course an exemption applies. It was for this reason that Mr Rutherford did not provide any copies correspondence requested. As a result Mr Rutherford did not rely on an exemption or refuse to provide the information.

However, upon reviewing this mater, I consider that it would be helpful to provide you with further information relating to this matter, that may be of assistance.

The consultation period ended on Thursday 23rd October. As explained in Mr Rutherfords response, the City Council and Consultants, IRIS, gave stakeholders access to the plans through a number of public and stakeholder focussed meetings held in September and October 2008. Originally there had been no intention to upload these plans, however, following requests, it was agreed that it would be useful to upload the plans and that this would be done at the end of the consultation. The plans, notes of the meetings and Q & As were uploaded on 29th October 2008. This was 4 working days following the end of the consultation.

There was a separate consultation regarding the primary school that ended on Thursday 30th October. All efforts were made to upload the plans before the end of this consultation period, and this was achieved. Although it may have been advantageous to upload the plans earlier in the consultation period on primary schools, this was not possible. The plans could not be uploaded before the end date of the consultation period on the secondary school.

In relation to your initial request for information I can confirm that there were no correspondence from the Councils IT department concerning problems with the upload. This is because there were no problems with the upload. The plans were originally forwarded to the City Council in a large, CAD format. This was changed to a PDF format for uploading. Once in this format, the plans were sent to the Councils IT department and were uploaded with no problems.

There was a limited amount of communication between the Council and IRIS concerning the posting of the plans and the date they would be posted by. The date agreed was the 29th October.
