Dear Mr McLaughlin

I write further to our e-mail dated 4 March 2009 concerning your request
for information relating to the expenses of the ICO’s Management
Board.  As you are aware we have treated this as a request for
information in accordance with the Freedom of Information Act 2000.

Your request asked for the same breakdown as that currently on our website
for Richard Thomas but for the rest of the Management Board for the same
period.  This information is not readily available in the format you have
requested as the information for Richard Thomas expenses comes from a
number of sources and then calculated to create this breakdown.  This is
the reason that a breakdown of expenses for the whole of the Management
Board is not currently in the guide to information but work is underway so
that it can be routinely published as part of the guide in future.

However, in order to provide you with the information that you are seeking
attached is a excel spreadsheet which has a number of individual sheets
within it.  The first sheet details the salaries of the Management Board
set out in bands of £5000 together with the details of expenses incurred
by those officers and employees for the years 2008/09 (to 17 March 2009)
and 2007/08.

It may also be helpful to provide further clarification on the above
information in that the expenses are supplied from three areas covering
the specified period.

1. Travel is usually booked through a travel agency for
which a list of transactions sort by individual is detailed in sheet four
of the attached spreadsheet.

2. Government Procurement Cards (VISA cards) are held by
some senior staff for incidental and last minute travel costs and
expenses.  These are held in a manual form only but we have provided a
summary detailed in sheet two.  Copies of the statements which fall
within the specified period have been collated and if you would like us to
send these copies to you please could you provide us with a postal
address.

3. Expense claims to reimburse costs met personally by
the office or employee.  A summary of the claims for each management
board member is detailed in sheet 3 however expense claim sheets are
submitted manually and therefore only held in hard copy.  As before we
have copied the sheets within the scope of your request and if you provide
a postal address we would be happy to send these to you.

I hope this information is of help and assistance. However, if you are
dissatisfied with the response you have received and wish to request a
review of our decision or make a complaint about how your request has been
handled you should write to the Internal Compliance Team at the address
below or e-mail [2][email address]

Your request for internal review should be submitted to us within 40
working days of receipt by you of this response. Any such request
received after this time will only be considered at the discretion of the
Commissioner.

If having exhausted the review process you are not content that your
request or review has been dealt with correctly, you have a further right
of appeal to this office in our capacity as the statutory complaint
handler under the legislation.  To make such an application, please write
to the Case Reception Team, at the address below or visit the
‘Complaints’ section of our website to make a Freedom of Information
Act or Environmental Information Regulations complaint online.

Thank you for this. Your footnote about Graham Smith not having
submitted expense claims makes me want to see your related guidance
to staff please, which is not available on your website. In my
experience one would expect expense claims to be submitted
promptly, and not at year end.

Dear Joanne,

Many thanks for this prompt reply, and the information provided.

I was puzzled by your advice that the information would normally be
treated as exempt: since it is not available except by asking for
it, it would seem nonsense to respond to a request by saying it is
otherwise accessible!

I don't need further advice on this, but I think you should
reconsider your general stance.
